I Sponsored by: Janke Introduction Date: April 26. 1999 Public Hearing Date: May 10. 1999 Enactment date: May 10. 1999 CITY OF SEWARD, ALASKA ORDINANCE NO. 99-05 AN ORDINANCE AMENDING SEWARD CITY CODE, CHAPTER 9.15, HEALTH AND SAFETY, ADOPTING THE LATEST VERSION OF THE UNIFORM FIRE CODE (1997), INCLUDING REVISIONS WHEREAS, as of March 27, 1999, the State of Alaska has adopted the 1997 Uniform Fire Code (UFC); and WHEREAS, revisions the State makes affects the City of Seward; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Seward City Code Chapter 9.15.110 is deleted is it's entirety and replaces with the following: Article 1. General Provisions 7 9.15.110 Uniform Fire Code-adopted. A. The 1997 edition of the Uniform Fire Code, Volumes I and II, and the Appendices listed in subsection B. below, published by the International Fire Code Institute is hereby designated and shall be known as the Seward Fire Code, and shall constitute the laws of the city related to fire prevention. Although not published in full in this section, all of the provisions of the Uniform Fire Code and the appendices cited above shall be and are hereby adopted by reference to the same extent as if set forth in full herein, except to the extent that the Uniform Fire Code is amended by or in conflict with this code or any relevant ordinance later adopted, in which case the provisions of this code shall prevail. B. The following amendments are made to the Uniform Fire Code, 1997 edition, in its application as the Seward Fire Code: 1. Article 1, section 105.8 is revised by deleting all permits except for e.1. Explosives or blasting agents and 0.1. open burning; 2. Article 2, section 220 is revised by the addition of a paragraph to read: "Service is the annual test, maintenance, or service defined and required by applicable fire equipment standards"; 7See S 12.05.015 as to adoption ofthe Dangerous Buildings Code; see S 11.10.065 and S 11.10.070 as to following fire equipment and crossing fire hose; see S 14.10.035 as to private use offire hydrants. Article 9, section 903.2 is amended to read, is hereby revised by amending the second sentence to read:"When any portion of the facility or building protected is in excess of 250 feet (76,200-mm) from a water supply on a public street, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains capable of supplying the required fire flow shall be provided when required by the chief; 4. Article 10, section 1001.5.2 EXCEPTION: is revised to read "1. After any use or activation. 2. Anytime damage is found. 3. After repair or alteration. 4. After seasonal shutdown. 5. When required by the Chief; 5. Article 10, section 1001.5.2, line 11, is amended to read "premises and forwarded to the Chief within 30 days of the inspection or test being completed. It is the responsibility of the person conducting the inspection or test to forward the copy of the report to the Chief"; 6. Article 10, section 1003.2.4.1, delete "Exceptions"; 7. Article 10, section 1006.2.1 is revised to read, "Where required. Approved automatic fire -extinguishing systems must be provided for the protection of commercial-type cooking equipment. Where residential-type cooking equipment is employed in a commercial kitchen and creates grease laden vapors, a type I hood and duct system with an approved automatic fire extinguishing system will, in the Fire Chiefs discretion, by required"; 8. Article 10, section 1006.2.8, line 12, is amended to read "....shall be serviced every twelve months or after activation of the system"; 9. Article 11, section 1104, Parade float, is deleted in its entirety; 10. Article 11, section 1111.2.2 is revised to read, "Operation. Fire assemblies must not be obstructed or otherwise impaired from proper operation at any time. When two or more self-closing assemblies within a building have been documented as having been obstructed or impaired during three or more consecutive inspections, the Chief may order the installation of automatic closing devices meeting the requirements of the UBC section 1004.3.4.3.2.1.";, 11. Article 12, Section 1202.2 is revised to read, "Abatement of buildings and structures with Inadequate exits. Buildings and structures that are not provided with adequate exits or emergency escapes are unsafe and must be abated"; 12. Article 13, is revised by the addition of "Section 1303.6.5, false alarms. False alarms may not be counted as a fire drill for the purposes of this article."; 13. Article 3 6, section 3 60 1. 5. 1 is revised to read, "Change in class. Solvents must not be changed to a solvent in a more hazardous classification unless such change has been approved by the Chief"; 14. Article 52, section 52024.4.3 is revised by the addition of an exception to read: "Exception: A vehicle or trailer tank with a capacity of 250 gallons or less may be used for non- commercial refueling or private non-commercial aircraft ifthe following requirements are met: a. The tank is placarded with no smoking signs, type of fuel contained in the tank and tank capacity. b. The tank and all appurtenance used in the fueling operation are listed and approved for the specific purpose; 15. Article 77, section 7703 .1.2 is revised to read, "The person in charge of the handling and . . I CITY OF SEWARD, ALASKA ORDINANCE NO. 99-05 use of explosive materials must be at least 21 years of age and possesses a valid explosive - use permit issued by the City"; 16. Article 77, section 7703.2.3 is revised to read "Authorization. Explosive materials must be transported on vehicles authorized by DOT."; 17. Article 78, section 7801.3.1.1 is revised to read, "Delivery of Fireworks. The delivery of fireworks to locations within this State is prohibited unless the vendor first obtains a license or permit from the State Fire Marshal and operates in a manner consistent with AS 18.72 and this article." ; 18. Article 78, section 7801.3.1.2 is revised to read, "Permits are required to conduct a fireworks display. Permit application shall be made not less than 14 days prior to the scheduled meeting date of the City Council prior to the display date. The permit application wi\l follow the City's permit requirements and procedures."; 19. Article 78, section 7802.1 is revised by adding to the first sentence, "and AS 18.72."; 20. Article 78, section 7802.2, is revised by adding to the sentence, "and AS 18.72."; 21. Article 78, section 7802.3 is revised to read, "Prohibition. Except as allowed by AS 18.72 and article 78, the storage, use and handling of fireworks is prohibited; 22. Article 79, section 7902.2.8.3.4, is revised to read, "diked areas containing two or more tanks must be subdivided by drainage channels leading to an impounding basin or by intermediate curbs or spill dikes in order to prevent spills from endangering adjacent tanks within the diked areas as follows' a. When storing normally stable liquids in vertical cone roof tanks constructed with a weak roof-to-shell seam or approved floating roof tanks or when storing crude petroleum in producing areas in any type tank, one subdivision for each tank in excess of 10,000 barrels (1589800 liters) and one subdivision for each group oftanks, no tank exceeding 10,000 barrel (1589800 liters) capacity, having an aggregate capacity not exceeding 15,000 barrels (2384700 liters); b. When storing normally stable, flammable or combustible liquids in tanks not covered in item 1, one subdivision for each tank in excess of2,500 barrels (397450 liters) and one subdivision for each group of tanks, no tank exceeding 2,500 barrels (397450 liters) capacity, having an aggregate capacity not exceeding 3,570 barrels (56778.6 liters); c. When storing unstable liquids in any type of tank, one subdivision for each tank, except that tanks installed in accordance with the drainage requirements ofUFC standard 79-2 need not be provided with additional subdivision; and d. The drainage channels or intermediate curbs must be located between tanks in a manner that takes full advantage ofthe available space with regard for the individual tank capacities. Intermediate curbs, where used, may not be less than 8 inches (457.2-mm) in height; 23. Article 79, section 7904.3.1 is revised by the addition of a second sentence that reads, "This division does not apply to offshore oil platforms."; 24. Article 80, section 8001.3 is deleted; 25. Article 82, section 8202, is revised to read, "section 8202, Plan Review. Where a single container is over 500 - gallon (1892.7 L) water capacity or the aggregate capacity of containers is over 500 - gallon (1892.7 L) water capacity, the installer shall submit plans for review before CITY OF SEWARD, ALASKA ORDINANCE NO. 99-05 installation in accordance with 13 AAC 50.27."; 26. The following Appendices to the 1997 Uniform Fire Code are hereby adopted: Appendix I1-BProtection of Flammable & Combustible Liquid Tanks in Locations Subject to Flooding; Marinas; Protected Above-Ground Tanks for Motor Vehicles Fuel Dispensing Stations outside Buildings; Fire Flow Requirements for Buildings; Fire Hydrant Locations and Distribution; Christmas Trees; Nationally Recognized Standards of Good Practice; Hazardous Material Classifications; Model Citation Program; Reference tables from the Uniform Building code; Recommend separation distances for explosives materials; Refrigerant Groups and Properties. Appendix I1-C Appendix I1-F Appendix III-A Appendix III-B Appendix IV-B Appendix V-A Appendix VI-A Appendix VI-D Appendix VI-E Appendix VI-F Appendix VI-H C. The city clerk is directed to keep on file at least three copies of the uniform Fire Code, 1997 edition, for public use, inspection and examination.
