HomeMy WebLinkAboutOrd1977-444 10-6-77 RHJ:vmo . . . e Intro~d By: City Manager Introduction Date: 10-10-77 Public Hearing and Enactment: 11-14-77 CITY OF SEWARD, ALASKA ORDINANCE NO. 444 AN ORDINANCE ADJUSTING THE FEES AND BONDS REQUIRED OF TRANSIENT MERCHANTS THE CITY OF SEWARD, ALASKA ORDAINS: Section 1. Section 16-5, Code of Ordinances of the City of Seward, Alaska, is hereby repealed and re-enacted as follows: Sec. 16-5. Same--Fees; bond; issuance. The license of peddling per day, or fee for engaging in or carrying on the business or hawking, or either, shall be fifty dollars two thousand dollars for one year. The license fee for an auctioneer, itinerant vendor or person engaged in a temporary or transient business of vending or selling merchandise, stocks or bonds or other articles of commerce shall be fifty dollars per day, or two thousand dollars for one year. The license fees above required shall accompany the application, or be deposited with the city clerk-treasurer before the license is issued. Before any license herein provided for is issued, the applicant therefor shall also deposit with the city clerk- treasurer a good and sufficient bond in the sum of five thousand dollars conditioned that the applicant will not cheat or defraud any person in any manner whatsoever in the business for which the license is desired during the term for which the license is granted, which bond shall be and remain in full force and effect during the time of such license and for ninety days after the expiration thereof. Such bond shall be approved by the mayor before the license is issued. Default in any of the conditions of the bond shall give the aggrieved party the right to sue and recover on such bond in his own name from the principal and sureties without joining the city as a party to such proceeding. (cont'd) After such application has been filed and such fee paid, and bond filed and approved, as above provided, the city clerk-treasurer shall, without undue delay, issue the license to the applicant, which license shall state the nature of the business, the fee paid, the place where the business is to be conducted if it be that of an auctioneer, itinerant vendor or person engaged in a temporary or transient business of vending or selling as aforesaid and the period of time for which the license is granted, giving the first and last date of such period. The license fee and bond requirements of this section shall not apply to temporary fund raising activities of charitable, religious, civic, educational or other non- profit organizations which have been operative within the City for a period of not less than one year and which have applied to the city clerk for the required license at least two weeks in advance of the scheduled sales or vending activity. Section 2. This ordinance takes effect immediately upon enactment. this ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, 14th day of November , 1977.
