RESOLUTION NO. 98-086
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, CONSENTING TO THE KENAI PENINSULA BOROUGH
PLANNING COMMISSION ACTION TO VACATE THE NORTH TEN
FEET OF BARWELL STREET BETWEEN CRISWELL STREET AND
HAROLD AVENUE ADJACENT TO LOT 24, BLOCK 3, BAYVIEW
ADDITION
WHEREAS, Linda Lynch petitioned the Kenai Peninsula Borough to vacate the north one-
half of Barwell Street between Chiswell Street and Harold A venue, adjacent to Lot 24, Block 3,
Bayview Addition; and
WHEREAS, the vacation was requested because the existing house on Lot 24, Block 3,
Bayview Addition encroaches up to 4 feet, 4 inches into the Barwell Street right-of-way; and
WHEREAS, it is unlikely that Barwell Street will ever be constructed because Scheffler
Creek runs down the south half of the right-of-way between Chiswell Street and Harold A venue;
and
WHEREAS, at its May 6, 1998 meeting, the Seward Planning and Zoning Commission
reviewed the petition and recommended that the Borough Planning Commission approve the
vacation request, subject to it being replaced with a 22 foot public utility/access easement; and
WHEREAS, at its June 22, 1998 meeting, the Kenai Peninsula Borough Planning
Commission vacated the north ten feet of the Barwell Street right-of-way between Chiswell Street
and Harold A venue; and
WHEREAS, the vacation serves to correct the right-of-way encroachment and continues
to maintain access to the private property to the west; and
WHEREAS, the Seward City Council has thirty days from that decision to veto approval
of the vacation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, that:
Section 1. The City Council hereby consents to the Kenai Peninsula Borough Planning
Commission's decision to vacate the north ten feet of the Barwell Street right-of-way located
between Chiswell Street and Harold Avenue adjacent to Lot 24, Block 3, Bayview Addition.
Section 2.
This resolution shall take effect immediately upon its adoption.
