CITY OF SEWARD, ALASKA
ORDINANCE NO. 472
AN ORDINANCE LEVYING THE ASSESSMENT FOR THE SPECIAL
IMPROVEMENT DISTRICT DESCRIBED AS THE JESSE LEE HEIGHTS
SUBDIVISION SEWER, WATER AND STREET IMPROVEMENT DISTRICT,
AND REPEALING RESOLUTION NO. 79-15 AND ORDINANCE NO. 469
WHEREAS, the City Council of Seward, Alaska, has conducted
a hearing to receive public comment concerning the fairness and accuracy
of the Special Assessment Roll for the Special Improvement District
described as the Jesse Lee Heights, Subdivision Sewer, Water and Street
Improvement District, and
WHEREAS, the City Council hereby finds that the Special
Assessment Roll fairly apportions the cost of the improvement in the
Special Improvement District,
WHEREAS, Resolution No. 79-15 passed by the City Council on the
9th day of April, 1979, incorrectly stated the interest rate and payment
provisions for the Special Improvements District and the accompanying
Ordinance No. 469 enacted by the City Council on the 9th of April, 1979,
recited the same erroneous terms;
WHEREAS, the City Council hereby finds that the Special
Assessment Roll fairly apportions the cost of the improvement in the
Special Improvement District
NOW, THEREFORE, THE CITY OF SEWARD ORDAINS:
Section 1. Resolution No. 79-15 and Ordinance No. 469 are hereby
repealed.
Section 2. The Special Assessment Roll, a copy of which is attached
hereto and incorporated herein by reference, for the Special Improvement
District described as the Jesse Lee Heights Subdivision Sewer, Water
and Street Improvement District is hereby adopted and there is hereby
levied against each property described on said roll the amount assessed
against it as set forth in the roll.
Section 3. The payment schedule and the penalty and interest
provlslon set forth in Resolution No. 79- 21 are hereby adopted and
may be utilized by owners of the affected property for paying the assess-
ment in installments.
Section 4. This Ordinance shall take effect immediately upon
adoption.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this
29th day of May, 1979.
