CITY OF SEWARD, ALASKA
ORDINANCE NO. 477
AN ORDINANCE AUTHORIZING THE PURCHASE OF LAND ON LOWELL POINT FOR
A SECONDARY SEWAGE TREATMENT PLANT AND DECLARING AN EMERGENCY
WHEREAS, the City Council has committed the City of Seward to the oonstruc-
tion of a secondary sewage treatment facility to comply with Federal and State
Environmental Regulations; and
WHEREAS, the City Council earlier decided that land located in Lowell
Point and owned by Mrs. Ethel Hardy is the best suited for that facility; and
WHEREAS, the City Council earlier authorized the purchase of an option on
that land which expires on the 30th day of June, 1979; and
WHEREAS, the City Council hereby finds that with respect to the exercise
of that option an emergency to the public health and safety exists in that there is
too little time before expiration of the option period to complete the purchase
pursuant to Sections 2-81 through 2-85 of the Seward City Code and that compliance
with those sections will preclude the City from purchasing this land which is
necessary for a safe treatment plant.
NOW, THEREFORE, the City of Seward ordains:
Section 1. The City Manager is hereby authorized and directe,i to exercise,
on behalf of the City of Seward, that certain option to purchase 11.1 acres, more or
less, on Lowell Point from Mrs. Ethel Hardy for a price not to exceed $ 111,000.00.
Section 2. This procedure of purchasing land by emergency ordinance is
deemed to satisfy all of the requirements for a valid purchase as if all of the
measures set forth in Sections 2-81 through 2-85 were fully and timely complied with.
The failure of the City to comply with all of the procedural requirements for the
purchase of real property set forth in Sections 2-81 through 2~85 shall not constitute
grounds to invalidate this purchase.
Section 3. This emergency ordinance shall become effective immediately
upon adoption.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this
25th day of June , 1979.
