Introduced By: City Attorney Introduction Da~t~e.: 04/25/83 Public Hearing & Enactment Date: 05/09/83 CITY OF SEWARD, ALASKA ORDINANCE NO. 514 AN ORDINANCE OF THE CITY OF SEWARD, ALASKA, AMENDING CHAPTER 20, SEWARD CITY CODE, TO ALLOW TRANSFER OF PUBLIC VEHICLE PERMITS WITH CITY COUNCIL APPROVAL, TO INCREASE INSURANCE REQUIREMENTS, AND TO DELETE GENDER BASED CLASSIFICATIONS WHEREAS, Chapter 20 of the Seward City Code prohibits the operation or lease of a public vehicle without first obtaining all required state licenses and a nontransferable permit from the City; and WHEREAS, there may be occasions when the transfer of a public vehicle permit is in the best interests of the City of Seward; and WHEREAS, in order to protect the public operation and leasing of public vehicles it is deemed City Council to approve any transfer of a permit; and interest in the necessary for the WHEREAS, the insurance requirements of Code Section 20-6 are deemed too low to adequately protect the public as well as public vehicle permit holders; and WHEREAS, the gender based classification in Code Section 20-17 is deemed to be unduly restrictive; NOW, THEREFORE, THE CITY OF SEWARD ORDAINS that: Section 1. Section 20-2 of the Code of the City of Seward, Alaska, is hereby amended to read as follows: Sec. 20-2. Permit required; transfer of permits. No person or entity shall operate or lease a public vehicle without first obtaining all required state licenses and a permit from the City to do so. Any permit holder wishing to transfer a public vehicle permit to another person or entity shall apply to the City Manager, who shall bring the request before the City Council for approval or denial. The City Council may withhold approval of the transfer of a permit if any reason or condition exists which would warrant refusal to issue a new permit to the transferee. The transfer of a permit need not be approved unless the Council, in its sole discretion, first determines that the proposed transferee is fit, willing and able to provide the appropriate services under the permit, that the transfer of the permit is com- patible with public convenience and necessity and is in the best interest of the public, and that the proposed transfer is . . . . . CITY OF SEWARDS ALASKA ORDINANCE NO. 14 compatible with all applicable laws, including but not limited to all provisions of Chapter 20 of the Seward City Code. Section 2. Section 20-6 of the Code of the City of Seward, Alaska, is hereby amended to read as follows: repealed. repealed. Sec. 20-6. Insurance. Before any public vehicle permit is issued or transferred, the applicant shall furnish evidence of the existence of one or more policies of in- surance, issued by an insurance company satisfactory to the City, providing liability coverage for the applicant in at least the minimum amounts of $100,000 per person, $300,000 per accident for bodily injury or death, and $50,000 property damage. This insurance policy shall require the insurer to give written notice to the City at least five (5) days prior to the cancellation, expiration, lapse, or other termination of the insurance coverage. A sign of a type approved by the City Manager, stating the limits of insurance liability and other pertinent in- surance information, shall be posted at all times in a conspicuous place in each public vehicle. Section 3. Section 20-9 of the Seward City Code is hereby Section 4. Section 20-17 of the Seward City Code is hereby Section 5. This ordinance shall take effect 10 days following enactment.
