ORDINANCE NO. 542
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AMENDING SECTIONS 8-10 AND 8-17(B) OF
THE CITY CODE RELATIVE TO CANDIDATE QUALIFICATIONS FOR
ELECTIVE OFFICE AND PUBLICATION OF NOTICE OF ELECTIONS
WHEREAS, the City of Seward revised Chapter 8 of the City Code
in July 1984; and
WHEREAS, a clerical error resulted in the omission of a phrase
in Section 8-10, Candidate Qualification; and
WHEREAS, this omission has altered the intent of this section
and has resulted in a Code provision in direct conflict with Section 2.2
of the City Charter; and
WHEREAS, Section 8-7 (b) states that publication of a notice
for a special election must be made ~ days prior to the election; and
WHEREAS, the City Charter, Section 10.2, mandates that such
notice of special election shall e published at least ~ days prior to
the election;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, HEREBY ORDAINS that:
Section 1. Section 8-10 of the Seward City Code is hereby
amended to read as follows:
Sec. 8-10. Candidate qualification. To be
eligible to file a declaration of candidacy for
election to a city office, a person shall be an
elector of the city and shall have been a resident
of the city or of the territory annexed to the city,
or shall have had a combination of residence in the
city and in the annexed territory for a period of
not less than one year immediately preceding the
date of filing such a declaration.
Section 2. Section 8-7(b) of the City Code is hereby amended
to read as follows:
(b) For special elections, publication shall
be made at least once no later than 20 days prior to
the special election. The notice of election shall
be posted in two places within the City.
Section 3. This ordinance shall take effect 10 days following
enactment.
