CITY OF SEWARD, ALASKA ORDINANCE NO. 576 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, CCNFIRMING EMEffiENCY ORDINANCE NO. 575 WAIVING THE Em;2UIREMENT THAT CITY E1'lPIDYEES REO:IVE A COST OF LIVING INCREASE FOR FISCAL YEAR 1987 AND AMENDING SECI'ION 17.4.4 - COST OF LIVING ALLa\1ANCE WHEREAS, a smrtfall in State and Federal revenue sharing has necessitated a reduction in City spending for Fiscal year 1987; and WHEREAS, Section 17. 4.4 of the City code requires that each classified arployee of the City receive a cost of living adjust.rrent, based on the Anchorage CPI for the one-year period ending May 30, effective July 1 of each year; and WHEREAS, the Ancmrage CPI for the year ending May 30, 1986, has been determined to be +3.6 percent; and WHEREAS, a 3. 6 percent across the board cost of living adjustrrent for classified enployees of the City \\QuId result in an increase of !lOre than $80,000 in budgeted salaries for Fiscal Year 1987; and WHEREAS, in order to rraintain City services at current levels the City Council by errergency Ordinance No. 575, enacted June 23, 1986, waived the requirerrent that City employees receive a cost of living increase for Fiscal Year 1987; and WHEREAS, the Seward Code requires the enact.rrent of an ordinance following a public hearing confirming the actions taken by errergency Ordinance No. 575; and WHEREAS, it is a finding of the City Council that a cost of living adjustrrent for enployees at this tirre \\QuId seriously tax the ability of the City to operate within budgeted revenues for the Fiscal Year beginning July 1, 1986; and WHEREAS, reduction in State and Federal revenue sharing is likely to continue given the Federal deficeit and decrease in the price of oil; and WHEREAS, given the decline in revenue sharing, the City Council finds it to be in the public interest to anend Section 17.4.4 of the City Code to allow greater flexibility in rraking employee cost of living adjustrrents; NCM, THEREFORE, THE CITY COUNCTI. The public interest would best be served by suspending the cost of living adjust.rrent set forth in Section 17.4.4 of the City Code for Fiscal Year 1987. Section 2. The cost of living adjust.rrent called for in Section 17.4. 4 of the City Code is hereby waived for the Fiscal Year beginning July 1, 1986. Section 3. Section 17.4.4 Cost of Living AlICMance is arrended to read as follCMs: Cost of Living Allowance. The pay plan nay be adjusted with the approval of the City Council on an annual basis on or before July 1st to reflect a cost of living allCMance (COlA) based upon the May 30 Anchorage M=tropoli tian area figure published by the Bureau of Labor Statistics, for all employees in the classified service, provided that changes nade in the pay plan to reflect a cost of living allCMance will be effective July 1st. CITY OF SEWARD, ALASKA ORDINANCE NO. 577 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, PROVIDING FOR PREQUALIFlCATICN OF BIDDERS WHEREAS, Section 10-8 of the Seward City Code provides certain provisions and restrictions to be folla.ved by the City when contracting for goods and services; and WHEREAS, the City Code does not address prequalification of bidders; and WHEREAS, nnder certain conditions the public interest would best be served by requiring prequalification of bidders; NCW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, HEREBY ORDAINS that: Section 1. Section 10-8 of the Seward City Code is hereby arrended by adding subparagraph (h) to read as folla.vs: (h) Prequalification of bidders or proposers nnder this section is permitted if the city manager determines that prequalification is in the public interest. Justification for prequalification may include but shall not be limited to the need to restrict bidding to firms having special kna.vledge and experience in the work required, or a need to expedite contracting procedures. A request for Letters of Intent shall be advertised in the rrenner prescribed at (a), not less than two weeks prior to the deadline for accepting the letters. The pub- lished request shall describe the task(s) to be perfomed, the minimum qualifications of firms to be selected, and procedures for evaluating those firms. Evaluation criteria may include, but shall not be limited to, the sane factors as listed at Section 10-8.1 for determining a responsible bidder. Firms will be either approved or rejected, with no rating designated to compare firms within either the approved or rejected category. At least three firms must be included in the approved category. The city conncil shall approve the prequalification list by resolution. requests for bids or proposals will be solicited from only those firms on the approved list and only those prequalified firms shall be allCMed to submit bids pursuant to this section. Section 2. This ordinance shall take effect ten (10) days folla.ving enactment. -1-
