HomeMy WebLinkAboutOrd1999-008 I I I Sponsored by: Janke Introduction Date: Mav 24, 1999 Public Hearing Date: June 14, 1999 Enactment date: June 14, 1999 CITY OF SEWARD, ALASKA ORDINANCE NO. 99-08 AN ORDINANCE AMENDING SEWARD CITY CODE, TITLE 3, PERSONNEL, CHAPTER 3.55 SEPARATIONS, ALLOWING FOR MORE FLEXmILITY REGARDING EMPLOYEE RESIGNA TIONS AND REHIRES WHEREAS, our current Seward City Code is written in such a way that any employee who resigns without at least fourteen days notice is permanently ineligible for rehire regardless ofall other factors relating to their employment; and WHEREAS, we do not believe it is prudent to permanently declare an individual ineligible for rehire with the City; and WHEREAS, the proposed amendment allows flexibility by making resignation without a 14 day notice a factor in consideration for future employment with the City; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The following sections of Seward City Code, Chapter 3.55.010, Resignations, are hereby amended as follows: Chapter 3.55 Separations 3.55.010 Resignations. A. To resign in good standing, an employee who desires to terminate employment shall give at least fourteen calendar days written notice to his immediate supervisor. The period of notice may be reduced or waived upon recommendation of the department head and approval of the city manager for extenuating circumstances; i.e., Family Medical leave, change of residence by unexpected military orders of the employee or spouse, etc. A notice of resignation shall become part of the personnel file. B. An employee may withdraw a resignation only under the following conditions: 1. the withdrawal is submitted to the department head before the effective date stated in the notice of resignation; 2. the position has not been filled; and 3. the withdrawal is accepted in writing by the department head with approval of the city manager. CITY OF SEWARD, ALASKA ORDINANCE NO. 99-08 C. Failure to give adequate notice shall be noted on the employee's separation documents and shall constitute a factor in consideration of any future application for employment with the city. D. The effective date of termination pursuant to a notice of resignation shall be the last day on which the employee works. The value of an employee's annual leave balance shall be paid to him without undue delay with his final paycheck following separation. There is no provision for terminal leave.
