CITY OF SEWARD, ALASKA
ORDINANCE NO. 606
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, ESTABLISHING CHAPTER 18 OF THE
SEWARD CITY CODE, PLANNING AND ZONING
WHEREAS, the Seward City Charter, Chapter 4.9, Zoning,
states that the city shall provide for the health, safety
and welfare of the citizens within the city by providing for
comprehensive building and zoning regulations; and
WHEREAS, prior to the establishment of the
peninsula Borough, the city did provide planning and
services to the citizens of Seward; and
Kenai

WHEREAS, AS 29.40.010 tasks second class boroughs with
planning, platting and land use regulation on an areawide
basis; and
WHEREAS, Section 21.01.020 of the Kenai peninsula
Borough Code of Ordinances provides that upon request by a
city, the borough assembly shall delegate zoning regulation
to the city; and
WHEREAS, AS

29.40.010 allows for the delegation of
use regulation powers from a borough to a
WHEREAS, the Kenai Peninsula Borough desires to dele-
gate zoning powers and certain land planning powers to the
city of Seward; and
WHEREAS, the city of Seward wishes to assume such
powers in order to better serve the needs of its citizens;
and
WHEREAS, Chapter 18 of the Seward City Code is vacant
and available to be designated PLANNING AND ZONING;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, HEREBY ORDAINS that:
Section 1. Chapter 18 of the Seward City Code is
hereby designated PLANNING AND ZONING.
Section 2. The city of Seward consents to the Kenai
Peninsula Borough delegating to the city of Seward powers to
regulate zoning and certain land use planning wi thin the

corporate limits of the city of Seward as established or as
may be modified in the future.
Section 3. This ordinance shall take effect ten (10)
days following its enactment.
