Sponsored by: Arvidson CITY OF SEWARD, ALASKA ORDINANCE NO. 614 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, ENACTING MISCELLANEOUS REVISIONS TO THE SEWARD CITY CODE, TITLE 4, ELECTIONS WHEREAS, the Alaska State Legislature's 1985-86 revision of Alaska Statutes, Title 29, provided for a new definition of a "qualified voter" allowing municipalities to require state voter registration in the municipal precinct in which a voter seeks to cast a ballot; and WHEREAS, the city Council wishes the Seward city Code to clearly reflect the ci ty' s intent to institute this addi tional voter qualification for municipal elections; and WHEREAS, the city administration recommends that in addition to Alaska Statutes Title 15, reference be made in the City Code to Alaska Statutes Title 29, Chapter 26, as the language pertains to the conduct of municipal elections; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. section 4.01.010 is hereby revised by amending the definition of "qualified voter" to coincide with AS 29.26.050, to read as follows: Qualified voter. Is any person who: 1. is a United States citizen who is qualified to vote in state elections; 2. has been a resident of the municipality for 30 days immediately preceding the election; 3. is registered to vote in state elections in the precinct in which that person seeks to vote in municipal elections; and 4. is not disqualified under Article V of the state constitution. Section 2. Section 4.01. 015 is hereby amended to add reference to the state election provisions found at AS 29 and applicable to municipalities, to read as follows: 4.01.015 Incorporation of state election provisions of Alaska Statutes Title 15 Chapter 26, relating to the conduct statutes. A. In accordance with AS 15.05.010 and AS 29.26.050, a person is qualified to vote in city elections who: 1. is a united States citizen who is qualified to vote in state elections~ 2. has been a resident of the municipality for 30 days immediately preceding the election; 3. is registered to vote in state elections in the precinct in which that person seeks to vote in municipal elections; and 4. is not disqualified under Article V of the state constitution. Section 4. This ordinance shall take effect ten (10) days following its enactment and following pre-clearance by the Federal Government Department of Justice, pursuant to the Voting Rights Act of 1965.
