CITY OF SEWARD, ALASKA
ORDINANCE NO. 624
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, REVISING CHAPTER 12.10
OF THE SEWARD CITY CODE, SIGNS
WHEREAS, the variance procedure outlined in Section 12.10.055
of the Seward City Code is restrictive to the point of not
providing any latitude by the Planning and Zoning Commission to act
on case by case requests; and
WHEREAS, a relaxing of the variance procedure will allow
flexibility in the code without rewriting the entire code; and
WHEREAS, the Planning and Zoning commission has recommended
that section 12.10.055 (A) (3) be revised to provide the Commission
greater latitude in reviewing sign variance requests;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Section 12.10.055 (A) (3), is hereby revised to
read as follows:
3. The commission may vary the rules, regulations
or provisions of this Code provided the commission, upon
due and diligent investigation, makes specific findings
that all of the following conditions have been
considered:
section 2. section 12.10.055 (A) (3) (b), is hereby revised to
read as follows:
b. That such variance is necessary because of
special circumstances such as, but not limited to, health
and safety, or the size, shape, topography, location or
surroundings of the subject property, to provide it with
signage use rights and privileges permitted to other
properties in the vicinity and in the zone which the
subject property is located;
Section 3. This ordinance shall take effect ten (10) days
following its enactment.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,
this 9th day of October, 1989.
