Sponsored by: Schaefermeyer CITY OF SEWARD, ALASKA ORDINANCE NO. 633 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SECTIONS 15.10.225 AND 15.10.240(C) OF THE CITY CODE REGARDING BED AND BREAKFAST USES WHEREAS, Bed and Breakfast use is an important aspect of visitor housing within the community; and WHEREAS, the city zoning code limits bed and breakfast uses to a single bedroom as a home occupation throughout the community; and WHEREAS, this interpretation precludes the use of residences within commercial zones; and WHEREAS, bed and breakfast uses within commercial districts should be considered as a business; and WHEREAS, there is a need to develop a more flexible use of bed and breakfast uses within the City Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Section 15.10.140 Definitions is amended to include a new definition for Bed and Breakfast as follows: Bed and Breakfast means an owner occupied and operated single family residential dwelling where lodging with a meal is provided for compensation on a short term basis. The term does not include boarding houses and separate apartments which are leased on a month-to- month or longer basis. section 2. Section 15.10.2401cl of the City Code is deleted in its entirety. Section 2. Section 15.10.225 Land uses allowed is amended to read: 15.10.225 Land uses allowed. A. Table 15.10.225, Land Uses Allowed (see pp. 25-29), is incorporated herein by reference and the restrictions contained therein are mandatory unless otherwise modified by this chapter. The -1- . . . CITY OF SEWARD, ALASKA ORDINANCE NO. 633 following codes are provided for information and interpretation (see also zoning District Designations, Section 15.10.210 and Section 15.10.220): CODES A = 0 = C = P = H = Blank = Accessory use (such as office with and apartment) Use allowed outright. Such use would not be reviewed by the Planning and Zoning Commission. Conditional Use Permit required from Planning and Zoning Commission. Permit from the city administration required - Addressed elsewhere in this title. Horne occupation Use prohibited within the specified zoning district. B. Bed and Breakfast. Bed and Breakfast is considered a home occupation within the residential districts and a business within the office residential, auto commercial and central business districts, subject to the following conditions: 1. The use will be limited dwelling which is the owner's residence. to an owner-occupied principal place of 2. Bed and Breakfast use may not use more than 50% (to a maximum of four) of the bedrooms within the home in residential districts and up to four bedrooms in the commercial districts. 3. Except in the CB and OR districts, one off- street parking space is to be provided for each bed and breakfast room in addition to those required for the residential dwelling. 4. No cooking or cooking facilities are permitted in the guest rooms. 5. Regardless of the date such use began, an annual administrative permit is required which includes a life safety inspection for adequate smoke detection systems, current Uniform Building Code door/window egress, and the presence of operable fire extinguisher. -2- . . Table 15.10.225, Land Uses Allowed, shall be amended to read as follows: USES Zoning Districts RM RESIDENTIAL/LODGING I Bed and Breakfast (City Seal) CP Section 4.
