Sponsored by: Arvidson CITY OF SEWARD, ALASKA ORDINANCE NO. 634 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING CHAPTER 3.65 OF THE CITY CODE RELATING TO LABOR AGREEMENTS FOR CONSTRUCTION OF PUBLIC PROJECTS WHEREAS, the public facilities community; and construction of projects that provide needed has a direct and immediate impact upon the WHEREAS, it has been the long-standing policy of the City Council of the city of Seward to encourage and promote wherever possible the construction of public projects utilizing local residents in order to maximize the public benefit from the construction of these projects; and WHEREAS, the City Council believes that the determination of the public interest in the award of construction contracts may involve a balancing of objectives including obtaining the lowest possible price for construction, encouraging and promoting the development of the local economy, and assuring labor peace; and WHEREAS, the city has permitted employees of the city to organize and collectively bargain with the city, and the city has a history of collective bargaining agreements; and WHEREAS, under federal law, work preservation clauses in agreements and the construction industry proviso provisions of the National Labor Relations Act, permit restrictions in the contracting for construction projects; and WHEREAS, the City Council of the city of Seward finds that it would be in the public interest to specifically authorize such contractual provisions in the public project construction context in that such provisions will assist in the public objective of local hire, preserve work for existing bargaining unit members, and promote labor peace and the efficient construction of public projects; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code Chapter 3.65 is amended with the addition of the following provision: 03.56.18 Construction project aqreements. Nothing in this Code shall prevent an agreement with a labor -1- . . . CITY OF SEWARD, ALASKA ORDINANCE NO. 634 organization relating to the construction of a public project that requires the contracting or subcontracting of work traditionally performed by employees represented by that labor organization to be performed by a signatory to a current labor agreement wi th that labor organization. Section 2. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 29th day of May, 1990.
