Sponsored by: Planning Commission CITY OF SEWARD, ALASKA ORDINANCE NO. 666 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SCC ~15.10.225, DELETING THE REQUIREMENT FOR A CONDITIONAL USE PERMIT FOR BED & BREAKFAST USE WITHIN THE SINGLE FAMILY RESIDENTIAL AND THE RURAL RESIDENTIAL ZONES WHEREAS, the Seward Zoning Code currently requires a Conditional Use Permit for the operation of a Bed & Breakfast in the Single Family Residential (Rl) and Rural Residential (RR) Zones; and WHEREAS, B&B is considered a home occupation in these districts; and WHEREAS, the Zoning Code addresses exterior business signs, life safety permitting, parking, length of stay, meals, number of B&B bedrooms, number of employees, owner occupancy and other issues with regards to B&B operations; and WHEREAS, the requirement for a Conditional Use Permit in the Rl and RR Zones appears to constitute an unnecessary expense to the applicant and a hindrance to establishing B&B's within the city; and WHEREAS, the City Council wishes to encourage the operation of B&B's within the city as a lodging alternative for Seward's growing visitor population; and WHEREAS, at its meeting of November, 6, 1991, the Seward Planning and Zoning Commission conducted a public hearing and approved a resolution recommending the deletion of the requirement for a Conditional Use Permit for Bed & Breakfast use in the Single Family Residential and Rural Residential Zones; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. The requirement for a Conditional Use Permit for Bed & Breakfast use in the Single Family Residential and Rural Residential Zones is hereby deleted. Section 2. Table 15.10.225, Land Uses Allowed, shall be amended to read as follows: . . . CITY OF SEWARD, ALASKA ORDINANCE NO. 666 Zoning Districts USES RM RESIDENTIAL/LODGING Section 2. Sponsored by: Schaeferrneyer CITY OF SEWARD, ALASKA ORDINANCE NO. 92-01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SCC ~ 5.18.200 BY CREATING A SALES TAX EXEMPTION FOR LICENSED CLINICAL SOCIAL WORKERS WHEREAS, SCC ~ 5.35.040(2) is a listing of professions in the human health service field whose services are exempt from sales tax; and WHEREAS, licensed clinical social workers provide services which are similar to other licensed health care providers; and WHEREAS, the state of Alaska regulates the licensing of this profession; and WHEREAS, the Kenai Peninsula Borough amended its sales tax code to provide an exemption for licensed clinical social workers; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Seward City Code Section 5.35.040(2) is hereby amended to read as follows: 5.35.040. Exclusions and exemptions - "Retail Sale," "Sale at retail" or "Sale" does not include: 1. .... 2. Hospital services and medical services performed by licensed medical doctors, dentists, osteopaths, optometrists, chiropractors, state-licensed private nurses, speech and hearing pathologists, physical therapists, state-licensed psychologists [AND] psychological associates, and licensed clinical social workers. and retail sales of medicinal preparations drugs or appliances for which a written prescription is required from one of the foregoing; ... 3. Section 2. This ordinance shall take effect immediately upon its adoption. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 27th day of January, 1992.
