CITY OF SEWARD, ALASKA
ORDINANCE NO. 92-13
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE
CHAPTER 4.10, ABSENTEE VOTING
WHEREAS, the Alaska Legislature approved HB 167, amending AS 15.20.010 and
AS 15.20.071 to allow absentee voting in person and by personal representative by a
person confined in an institutionj and
WHEREAS, the city wishes to amend its election code to conform to state statutesj
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA HEREBY ORDAINS that:
Section 1. Section 4.10.010 of the Seward City Code is hereby amended to read
as follows:
4.10.010 Eligibility.
Any qualified voter may vote an absentee ballot for the precinct in which he
resides and is registered:
A. if he believes he will be unavoidably absent from his voting precinct
on election day; or
B. if he will be unable to be present at the polls because of physical
disability or confinement in an institution. For the purposes of this chapter,
institution means a hospital, pioneer home, senior center or rehabilitation center
other than a correctional or psychiatric institution.
Section 2. Sections 4.10.025 A. and E. of the Seward City Code are hereby
amended to read as follows:
4.10.025 Absentee voting by personal representative.
A. A qualified voter who is physically disabled or confined to an
institution as defined in ~ 4.10.010 B. of this Code may be assisted by a personal
representative in voting an absentee ballot as set out in this section.

E. A candidate for office at that election, the voter's employer, agent of
the employer or officer or agent of the voter's union may not act as a personal
representative.
Section 3. This ordinance shall take effect ten (10) days following its enactment.
