RESOLUTION NO. 98-109
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING AMENDMENTS TO THE FY 1999 LEGAL
BUDGET AND APPROPRIATING FUNDS
WHEREAS, with the billings through August 20,1998 (16.7% ofFY 99) the General Fund
legal is at 23.1 % of budget, the Harbor Fund is at 15.7% of budget, the Electric Fund is at 17.7% of
budget and the Water/Sewer Fund is at 0.0% of budget; and
WHEREAS, overall, legal expenditures through August 20, 1998, total $30,568 and is at
20.6% of the FY 99 overall legal budget; and
WHEREAS, the City has received reimbursement oflegal fees from the State of Alaska for
the legal subjecct 1031, Spring Creek Refunding - 1998, in the amount of$3,205; and
WHEREAS, a new legal subject matter 4031, McFarland Contract, was created to account
for the legal costs related to the termination of the parking contract with Randy McFarland; and
WHEREAS, the legal fees for this subject matter will be charged to the Parking Revenue
Enterprise Fund; and
WHEREAS, no FY 99 budget was established for legal fees in this Fund and City Attorney,
Brad Meyen, has recommended that the budget for this subject matter be established at $7,500; and
WHEREAS, the FY 99 expenditures for this Fund were budgeted at $19,800 for
maintenance of parking lots, fee to the Harbor Enterprise Fund for use of property, PIL T and
administrative fees; and
WHEREAS, there is not enough monies within the existing budget appropriation of$19,800
for the legal fees; and
WHEREAS, it is recommended that Council appropriate $7,500 to the FY 99 budget for
legal fees in the Parking Revenue Enterprise Fund;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. The sum of $7,500 be appropriated from the Parking Revenue Enterprise Fund
retained earnings account 403-0000-3050 and transferred to subject matter 4031, McFarland
Contract, account 403-1io&-5170-4031 in the Parking Revenue Enterprise Fund.

Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 14th
day of September, 1998.
