Sponsored by: lones Introduction Date: 01/17/94 Public Hearing Date: 01124/94 CITY OF SEWARD, ALASKA ORDINANCE NO. 94-05 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CONVEYANCE BY THE CITY OF SEWARD OF ITS INTEREST IN LOT TWO A (2A), BLOCK TWELVE (12), CHAMBERLAIN ROAD REPLAT, SEWARD TOWNSITE CLIFF ADDITION, AND WAIVING THE PROVISIONS OF CHAPTER 7.05 OF THE SEWARD CITY CODE WITH RESPECT TO SUCH CONVEYANCE WHEREAS, the City of Seward is the owner of real property formerly described as Lot 3, Block Twelve, Seward Townsite Cliff Addition in the City of Seward ("Lot 3")i and WHEREAS, the City received Lot 3 as a donation from a private party because the topography of Lot 3 is not suited for development, and the City has not dedicated Lot 3 to any public use; and WHEREAS, Lot 3 was resubdivided as part of a replatting of several lots and relocation of the Chamberlain Road right-of-way, known as the Chamberlain Road Replati and WHEREAS, to accommodate the efficient relocation of the Chamberlain Road right-of-way, the creation of an adjacent utility easement, and the development of the adjacent lot, now known as Lot Two A (2A), Block Twelve (12), Chamberlain Road Replat, Seward Townsite Cliff Addition ("Lot 2A"), a portion of Lot 3 consisting of 623 square feet, more or less, was included within the new boundaries of Lot 2Ai and WHEREAS, the Council finds that said portion of Lot 3 contained within the boundaries of Lot 2A has no market value, and is of no value for any public usei and WHEREAS, the Council finds that it is in the public interest that said portion of Lot 3 within the boundaries of Lot 2A be conveyed by the City by quitclaim deed to the owner of the remainder of Lot 2A, for the purpose of facilitating the financing of improvements to Lot 2A that will enhance City tax revenueSi and WHEREAS, the Council finds that the conveyance of said portion of Lot 3 within the boundaries of Lot 2A should occur as soon as possible, and that no public purpose would be served by delaying the effective date of this ordinance authorizing such conveyancei . . . CITY OF SEWARD, ALASKA ORDINANCE NO. 94-05 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Notwithstanding anything to the contrary in Chapter 7.05 of the Seward City Code, the disposition by negotiation of all of the City's interest in the real property described as Lot Two A (2A), Block Twelve (12), Chamberlain Road Replat, Seward Townsite Cliff Addition, Seward Recording District, Third Judicial District, State of Alaska, to Blaine and Jean Bardarson, is hereby determined to be in the public interest and is approved. Section 2. The City Manager is hereby authorized and directed to execute and deliver a quitclaim deed in the form presented to this meeting conveying all of the City's interest in the real property described as Lot Two A (2A), Block Twelve (12), Chamberlain Road Replat, Seward Townsite Cliff Addition, Seward Recording District, Third Judicial District, State of Alaska, to Blaine and Jean Bardarson. Section 3. Notwithstanding anything to the contrary in Section 7.05.210 of the Seward City Code, notice as provided in Section 2.15.035 of the Seward City Code shall be sufficient notice of the public hearing on the disposition authorized herein. Section 4. Notwithstanding anything to the contrary in Section 2.15.050 or Section 7.05.135 of the Seward City Code, this ordinance shall take effect immediately upon its enactment.
