RESOLUTION 98-114
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE
AMENDMENT NO.2 OF THE CONTRACT WITH USA WASTE SERVICES,
INC. EXTENDING THE TERM OF THE CONTRACT FOR ONE
ADDITIONAL YEAR
WHEREAS, the City of Seward entered into a contract for collection and disposal of
garbage, rubbish and waste material with Jason McDonald, d.b.a. Jason Enterprises on October 12,
1992; and
WHEREAS, this contract followed approval of the voters of Seward of a franchise
agreement for the collection and disposal of garbage and refuse and was to be in effect for five years
beginning January 1, 1993, with options to extend, upon satisfactory performance, for up to three
additional one-year terms; and
WHEREAS, the first ofthe one year extensions was approved August 11, 1997, extending
the contract until December 31, 1998, and according to the terms of the contract, it is time for
consideration of the second additional one-year term; and
WHEREAS, USA Waste Service, Inc. recently purchased Jason Enterprises and one of the
conditions of the deal was the assignment of this contract from Jason Enterprises to USA Waste
Service; and
WHEREAS, the City Council approved the assignment of the contract on June 27, 1998,
and it was completed on or about August 13, 1998; and
WHEREAS, the administration offered USA Waste Services, Inc. the opportunity to extend
the contract, conditioned on City Council approval, as their performance has been more than
satisfactory;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council hereby approves Resolution 98-114, approving amendment No.
2 to the contract with USA Waste Services, Inc. for the collection and disposal of garbage, rubbish
and waste material in the City of Seward, Alaska, extending the term of the contract for one
additional year until December 31,1999, and authorizing the City Manager to sign Amendment No.
2.

Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe city of Seward, Alaska, this 28 day
of September, 1998.
