Sponsored by: Tones Introduction Date: March 29, 1994 Public Hearing Date: April 11, 1994 CITY OF SEWARD, ALASKA ORDINANCE NO. 94-21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, REVISING THE CITY PERSONNEL CODE TO CONFORM TO STANDARDS ESTABLISHED IN THE STATE AND FEDERAL FAMILY AND MEDICAL LEAVE ACTS WHEREAS, the passage of state and federal Family and Medical Leave Acts makes it necessary to revise the city's personnel policies regarding maternity leave and leave without pay; and WHEREAS, city employees were provided a copy of the proposed revisions and were given an opportunity to express their concerns regarding the mandated changes; and WHEREAS, the administration has received no adverse comments from city employees with regards to the proposed revisions; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code ~ 3.45.095 is hereby amended to read as follows: 3.45.095 Family and Medical Leave. A. Family and medical leave will be provided as required by state and federal law in effect at the time that the employee requests family and/or medical leave. B. An employee taking family and/or medical leave under state and federal law is required to substitute accrued annual leave for such leave until all accrued leave is exhausted. Once accrued annual leave is exhausted, any remaining period of family and/or medical leave will be unpaid. C. State and federal law entitles an eligible employee to take up to eighteen weeks of medical leave in a 24-month period and eighteen weeks of family leave in a 12-month period measured backward from the date the leave is used. D. Employees requesting family and medical leave are required to comply with the thirty day notice requirement, the certification requirement and other requirements of the Federal Family and Medical Leave Act when such requirements are applicable. . . While an employee is on unpaid family/medical leave, no benefits will accrue except health insurance, which will continue to be paid as long as employed by the city. Section 2. Seward City Code g 3.45.075 is hereby amended to read as follows: 3.45.075 Leave without pay. A. Purpose and conditions. Leave without pay may be granted to an employee upon recommendation of the department head and approval of the city manager. Each request for such leave shall be considered in the light of the circumstances involved and the needs of the organization. Leave without pay shall not be requested nor granted until such time as all accrued annual leave has been exhausted, except when an employee is absent and drawing workmen's compensa- tion pay. Nonnally, not more than sixty calendar days leave without pay may be granted for personal reasons. No benefits will accrue while on leave without pay except insurance which will continue to be paid as long as employed by the city. B. Education leave without pay. Leave without pay may be granted to an employee for training in subjects related to his public seroice. Employees who have demonstrated above average perfonnance with the city for a minimum of two years shall be considered for such leave, providing the work situation pennits a temporary absence without serious effect upon the department's schedule of activities. A maximum of ninety days' leave may be granted in such cases. No benefits shall accrue while on this type of leave without pay, except insurance, which will continue to be paid as long as employed by the city. C. Family and/or medical leave without pay. Employees requesting family and/or medical leave under state and federal law are required to comply with the requirements contained in g 3.45.095. D. Employees seeking unpaid family and/or medical leave beyond that required by state/federal law and employees seeking unpaid leave for any other reason are required to request such leave at least thirty days before the unpaid leave is to begin if the need for leave is foreseeable. If thirty days notice is not practicable, notice must be given as soon as possible. E. The city may require, at its discretion, that a request for unpaid medical leave beyond that required by state and/or federal law be supported by a certification issued by the health care provider of the employee or the employee's ill family member. Section 3. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 11th day of April, 1994. -2- . . .
