Sponsored by: Jones Introduction Date: 09/26/94 Public Hearing Date: 10110/94 CITY OF SEWARD, ALASKA ORDINANCE NO. 94-33 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE ~ 3.15.040 AND ~ 3.15.060, OVERTIME THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code 9 3.15.040 A. is hereby amended to read as follows: 3.15.040 Rerzular vart-time emvlovment. A. Regular part-time employees who are not exempt from the overtime requirements of the federal Fair Labor Standards Act shall be compensated on an hourly basis equivalent to the hourly rate established for the regular full-time employment at Step "A" of the pay range for the actual number of hours worked in each payroll period. Initial salaries for regular part-time employees who are exempt from the overtime requirements of the federal Fair Labor Standards Act shall be based on the hourly rate established for the regular full-time employment at Step "A" of the pay range multiplied by 2,080 and prorated to reflect the employee's part-time status. (E.g., assuming Step "A" of the applicable pay range is $10 per hour, an exempt employee's salary for working half-time would be equal to $10 x 2,080 x 0.5 regardless of the actual number of hours worked. Appointments shall be in probationary status and a probationary pay increase shall be awarded, if earned, when the hours worked have a cumulative total of 1.040 hours, which is equivalent to a six-month probationary step increase as set forth in i 3.15.035. Section 2. Seward City Code 9 3.15.060 is hereby amended to read as follows: 3.15.060 Overtime. A. Generallv. Overtime compensation will be paid to all employees except for those in probationary, regular or acting positions determined to be exempt from the overtime requirements of the federal Fair Labor Standards Act. Overtime hours shall be paid at time and one-half and shall be paid in accordance with the applicable provisions of the federal Fair Labor Standards Act. Employees who are not exempt from the overtime requirements of the federal Fair Labor Standards Act and who are requested to work overtime shall be paid at time and one-half for overtime hours. CITY OF SEWARD, ALASKA ORDINANCE NO. 94-33 holiday shall be paid at time and one-half for all hours worked on such holiday in addition to holiday pay under Chapter 3.50. B. Avvroval of overtime work. All overtime worked must have the approval of the department head concerned prior to its performance, except in cases of emergency which preclude such prior arrangements, and shall be paid in accordance with applicable federal and state laws. The department foreman or other person in charge of providing emergency service shall see that the overtime hours are properly recorded. The department head shall review the record and certifY to the finance department any overtime approved for payment as soon as practical thereafter. C. Overtime vav for volice officers. Police officers who are not exempt from the overtime requirements of the federal Fair Labor Standards Act, when required to attend a court session while not on regular duty, shall be entitled to overtime pay. D. Excevtions for shift rotation. An exception to overtime pay for work over eight hours in a twenty-four hour period is that due to shift rotation, provided there has been off-time of at least eight hours between shifts. E. Shift differential. Shift differential compensation applies to all employees of the City of Seward who are not exempt from the overtime require- ments of the federal Fair Labor Standards Act on the following bases: I. Swing shift. The employee who is assigned to swing shifts shall receive two and one-half percent additional pay to his regular salary for the period he serves on swing shift. The term "swing shift" is defined as the hours from 4:00 p.m. until midnight. 2. Gravevard shift. The employee who is assigned to graveyard shifts shall receive five percent additional pay to his regular salary for the period he serves on graveyard shift. The term "graveyard shift" is defined as the hours from midnight until 8:00 a.m. Section 3. This ordinance shall take effect ten (10) days following its enactment.
