Sponsored by: Planning & Zoning Commission Introduction Date: January 9. 1995 Public Hearing Date: January 23. 1995 CITY OF SEWARD, ALASKA ORDINANCE NO. 94-56 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SCC CHAPTER 15.10, ZONING CODE, TO CLARIFY AND CORRECT DISCREPANCIES WHEREAS, continuous use, interpretation and review of Chapter 15.10 of the Seward City Code has resulted in the discovery of several discrepancies; and WHEREAS, ongoing review and amendments are necessary to address the changing conditions of the community and to provide consistent, accurate information to city officials, staff and the public; and WHEREAS, certain Sections of Title 15 of the Seward City Code require revision and clarification; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. The following sections of the Seward City Code, Chapter 15.10, Seward Zoning Code, are hereby amended to read as follows: 15.10.235 Townhouses. A. Generallv. The standards set forth in this section shall compliment the general standards set forth in this chapter and shall not be construed as superseding any general standard. In the event of conflict, the stricter standard shall control. Notwithstanding the provisions of any other section of this chapter, townhouses shall be conditionally permitted in accordance with the Land Uses Allowed Table 15.10.225, if the following requirements are met. 15.10.240 Home occupations. A. Intent. It is the intent of this chapter to permit home occupations which are compatible with other permitted uses and with the residential character of a neighborhood, and which are clearly secondary or incidental to the residential use of the main building. In general, a home occupation is an accessory use so located and conducted that the average neighbor, under normal circumstances, would not be aware of its existence. So long as all the develop- ment requirements of this section are met, home occupations are permitted accessory uses as identified in the Land Uses Allowed Table 15.10.225. . . . CITY OF SEWARD, ALASKA ORDINANCE NO. 94-56 15.10.320 Conditional use permit. E. Expiration--Extensions. An approved conditional use permit lapses six (6) months after approval if no building permit is procured or if the allowed use is not initiated. The commission may grant time extensions not to exceed six months each... Section 2. Development Requirements Table 15.10.220 is hereby amended by adding a footnote to require no minimum Lot Size, Width or Setbacks in the Industrial Districts for unmanned electronic sites. Section 3. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 23rd day of January, 1995.
