Fil~ City Clerk-Treasurer ATTACHED TO AND MADE A ~ART OF THE MINUTES OF THE SEWARD CITY AN ORDINANCE AMENDING SECTION 3-2 OF THE SEWARD CODE OF ORDINANCES TO PROHIBIT THE CARRYING OF OPEN CONTAINERS OF ALCOHOLIC BEVERAGES IN PUBLIC AREAS WITHIN THE CITY. THE CITY OF SEWARD, ALASKA, ORDAINS: Section 1. Section 3-2 of the Seward City Code is hereby amended to read as follows: Sec. 3-2 Consumption and Possession in Public Places, Unlicensed Establishments, etc., Prohibited. (a) No person shall consume any intoxicating liquor on the public streets, parks or in any other public place, including any store or establishment open to or doing business with the public not licensed to sell intoxicating liquor for consumption on the premises. (b) No person shall have an open bottle, glass or other open container containing any intoxicating liquor in his pos- session on the public streets, parks, or in any other public place, including any store or establishment open to or doing business with the public not licensed to sell intoxicating liquor for consumption on the premises. This subsection (b) is applicable in that area of the City bounded by Jefferson Street, Third and Fifth Avenues extended south to the water- front, and the waterfront. (c) No person or business organization which owns, oper- ates or controls any public establishment or store shall per- mit a violation of subsections (a) or (b) to occur on the premises. (d) No exception to the provisions of subsections (a) or (b) shall be allowed, unless approved and prior authority therefor be granted by the chief of police. Section 2.
