CITY OF SEWARD, ALASKA
RESOLUTION NO. 98-126
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE THE
TERMINATION OF LAND LEASE 69-008, AND THE AMENDMENT OF
LAND LEASE 68-009, MARK CLEMENS, KNOWN AS LOTS 1 ND 2,
BLOCK 1, MARINA SUBDMSION, TO AMEND BY REMOVING THE LOT
LINES BETWEEN LOTS 1 AND 2 AND EXTENDING THE TERM OF THE
LEASE AN ADDITIONAL TEN YEARS.
WHEREAS, the City entered into a lease agreement with Mark A. and Joan L. Clemens for
Lots 1 and 2, Block 1, Marina Subdivision on July 22,1992, for a period of20 years, for "harbor
commercial purposes"; and
WHEREAS, these leases were subsequently assigned to Mark A. Clemens on July 24, 1996;
and
WHEREAS, since the new building will cross existing lot lines, the Lessee has replatted
Lots 1 and 2 into a single piece ofland; and
WHEREAS, this in effect modifies Land Lease RE-69-008 by removing the lot line, the City
and the Lessee have agreed to terminate this lease effective November 25, 1998; and
WHEREAS, Land Lease RE-68-009 has been amended to include the entire area originally
described as Lots 1 and 2, Block 1, Marina Subdivision; and
WHEREAS, Lessee has requested an extension of his lease term for an additional ten years
in order to secure financing for a new buildinglhardware store; and
WHEREAS, this would take the lease out to July 21, 2022;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized and instructed to execute the Lease
Termination and Amendment on behalf of the city on the date it becomes effective; and
Section 2. This resolution shall take effect thirty (30) days after passage and posting as
required by law.
