HomeMy WebLinkAboutOrd1964-335 Ir ORDINANCE NO. 335 AN ORDINANCE OF THE CITY OF SEWARD, ALASKA, PROVIDING FOR THE EXCHANGE OF WARRANTY DEEDS WITH CERTAIN INDI- VIDUALS WHO LOST THEIR HOMES IN THE GOOD FRIDAY DISAS- TER, PROVIDING THE CONDITIONS THEREFOR, AND DECLARING AN EMERGENCY. THE CITY OF SEWARD, ALASKA ORDAINS: (1) That Ordinance No. 315 of the City of Seward, inso- far as it conflicts with this Ordinance, is amended to provide for the following; (a) The City Manager and City Clerk are authorized and instructed to~prepare and issue, on behalf of the City of Seward, General Warranty Deeds as set out in this Ordinance, in exchange for General warranty Deeds for the same number of lots, to those persons who (1) lost their homes in the recent disaster, (2) actually occupied the premises as a home at the time of said l.ss, (3) can give a deed clear of any mortgages or other encumbrances, (4) can show satis- factory evidence to the City Manager that they have the ability and desire to immediately reconstruct a suitable home on said property for their own use, and (5) will agree to complete said structure within one (1) year from the date of the granting of said deed, including complete painting of the outside and landscaping to blend with other structures in the same neighborhood. (b) Property to be exchanged by the City shall be that property acquired by tax foreclosure or otherwise, which has not been dedicated by the City Councilor which may be re- moved from said dedication by the City Ceuncil. Selecti.n of the property shall be by the citizen recipient as foll.ws: (1) those making application and selecti.n first shall be given first choice, (2) those persons who resided in the City Limits of Seward prior to March 27, 1964, shall be given ten (10) days from the passage of this Ord:inance to make select~ns, (3) following ten (10) days after the passage of this Ordinance both those within and without the City shall be allowed to make selection without preference. (e) No property shall be transferred under this Ordinance after October 1, 1964. All selections must be made and all deeds executed prior to that date. - 1 - (d) Persons building on lots so deeded shall observe all codes and regulations as though the property were acquired on the open market. (2) Due to the fact that many persons suffered great loss in the disastrous earthquake, fire and tidal waves of March 27, 1964, an emergency is hereby declared to exist and the rules governing the intro- duction, reading, passage and approval of ordinances are hereby sus- pended, and this Ordinance shall become effective iIllnediately upon its passage, approval, posting and publication, as required by the City Charter. Publication of this Ordinance shall be made by posting a copy hereof on the City Hall Dulletin Loard in the basement of Seward General Hospital, Seward, Alaska, and by publishing a notice of posting and a brief statement of the purpose of this Ordinance in a newspaper of general circulation in the City within a reasonable time.
