AN ORDINANCE REPEALING ORDINANCE NO. 303 AND MODIF1'ING SECTION
5.100 (e) OF THE SEWARD GENERAL CODE REGARDING THE USE OF FIREA~.
Am GUNS. AND BB GUNS.
THE CITY OF SEWARD, ALASKA. ORDAINS:
That Ordinance 303 and Section 5.100 (e) of the Seward
General Code be, and the same hereby is repealed and replaced with
the following Section 5.100 (e):
Section 5.100 (e) discharge any firearms, air rifle. BB
or pellet gun within the corporate limits of the City of Seward.
without first having applied for and obtained a temporary permit
from the City Manager or Chief of Police, .r their duly authorize4
designee. Temporary permits may be granted for limited areas for
the purpose of: (1) Hunting. both large game and small game and
fowl (land and water), (2) Conducting a private or public rifle
range or game preserve, (3) Other customary purpeses. The
issuance of such permit shall not be unreasonably withheld, giviIl4
due consideration to: (1) the area for which the permit is
requested, (2) the purpose for which the permit is requested.
(3) the density of the populati~. and maJ"...-made improvements in
the area for which the permit is requested, and (4) the activities
that are or may be carried on within the range of the firearm. air
rifle. BB or pellet gun. Such permits shall be valid for the
period of time specified thereon, or until revoked or modified
by the City Manager or Chief of Police, or their duly authorized
designee, or until this Ordinance is repealed by pperation of law
or action of the City Council for the City of Seward.
Due to the existing need to provide rules and regulations
for the use of firearms, etc. in the newly annexed area consistent
with the occupancy of this area prior to the close of the present
hunting season, an emergency is hereby declared to exist, and the
rules governing the introduction. reading, passage and approval
of ordinances are hereby suspended. and this ordinance shall
become effective immediately upon. itl'1 passage. approval. pcst1ng

and publication as required by the City Charter.
Publication of this ordinance shall be made by posting
a copy hereof on the City Council bulletin board and by publish-
ing a notice of the place of posting and a brief statement ef the
purpose of this ordinance in a newspaper of general circulation
in the City within a reasonable time.
Passed by the Council of the City of Seward, Alaska, on
this 8th day of September, 1964.
