HomeMy WebLinkAboutOrd1953-238 ORDINANCE NO. 238 AN ORDINANCE OF THE CITY OF SEWARD, EsrABLISHING THE OFFICE OF CITY l.fANAGER AND DEFINING THE FCMERS AND DUTIES OF THE CITY MANAGER BE IT ORDAINED BY THE OJMl1JN OOUNCIL OF THE CITY OF SEI'lARD, AlASKA: Section 1. Cd The office of City Manager for the City of Seward h hereby established. The City Manager Shall be appointed by A MAJORITY VOTE OF THE ~ HERS OF the City Council solely on the basis of his executive and administrative qualifications, and shall hold office during the pleasure of the City Council, and may be removed for cause by a vote of a maj ori ty of all the members of the Council. No person elected to membership on the City Council shall, subsequent to such election, be eligible for appointment as City Manager until one year has elapsed following the expiration of the last term for which he was elected. (b) Before assuming office, the City Manager shall take and subscribe an oath to faithfully discharge the duties of his office and shall furnish a bond in such sum and with such sureties as the Council bl resolution may require, conditioned upon the faithful performance of his duties as such Ci ty Manager. Section 2. The City Manager shall be the administrative head of the City GO\I'ernment under the diredtion and control of the Council. He shall be respon- sible to the Council for the efficient administration of all affairs of the City which are under his control. In addition to the City Manager's general powers as administrative head, and not as a limitation thereon, it shall be his duty and he shall have power: (a) Execute and enforce all ordinances and resolves of the community and carry out all contracts entered into ~ it; (b) Appoint and remove the heads of departments, boards, and bureaus and all other officers and employees of the City except the City Treasurer and the City Attorney, who shall be appointed by the Common Council under existing law. (c) To exercise control over all departments and divisions of the City Government and over all appointive officers and employees thereof sub- ject to the apprO\l'al of the Council, except as herein provided. (d) To attend all meetings of the Council and its committees unless excused therefrom by the Councilor the committee, and except when his removal is under consideration by the Council. Ce) Make such recommendations to the Council as he may deem expedient or necessary and once a year present a detailed statement of wnat he has done during the year covered by the report. (f) To keep the Council at all times advised as to the financial conditions and needs of the City. (g) To prepare and recommend to the Council an annual budget. To prepare and r econnnend to the Council a requisition and purchase order system, or other proper administrative procedure to incur needed city expenses, and make payments thereunder, wi thout separate approyal of the council as to each transaction or item invol vedt, No expenditure shall be sul::mitted or recollUIlltnded to the Council except upon report or aryprova:). of the City Manager. ~- ,.., (j) To make investigations into the affairs of the City, or any department or division thereof, or any contract, or the proper performance of any obligation running to the City. (k) To investigate all complaints in relation to all matters concerning the administration of the government of the City and in regard to the service maintained by public utilities in the City, and to see that all fran- chises, permits and privileges granted by the City are faithfully observed. (1) To exercise general supervision over all public buildings, public parks, streets and other public property which are under the control and jurisdiction of the Council. (m) To superintend the construction of all public work wi thin the City. (n) To devote his entire time to the duties and interests of the City. (0) To perform such other duties as may be assigned to him by the Council. Section 3. Except for the purpose of inquiry, the Council and its members shall deal with the administrntive service solely through the City Manager, and neither the Council nor any member thereof shall give orders to any of the sub- ordinates of the City Manager. Section 4. The City Manager shall receive such salary as the Council shall from time to time determine and fix by resolution or motion. Section 5. In case of absence or disability of the manager the 80uncil may apl)oint a qualified person to perform the duties of the 11anager temporarily. If the office of Manager becomes vacant it shall apcoint without delay either a new Manager or an acting l1anager to fill the office until a new Manager is chosen. Section 6. All officers appointed by the Manager shall hold office for an indefinite term and may be removed by the Manager at p1easurH. T11eir compensation shall be fixed by ordinance and may be changed at any time. Section 7. All ordinances or parts of ordinances in conflict ~ith any of the provision of this ordinance are hereby repealed. Section 8. An emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately after its passage and approval. PASSED AND Ai: PROVED this 21st day of December, 1953.
