ORDINANCE NO. 262
AN ORDINANCE CREATING STREET IMPROVEMENT DISTRICT NO.1 WITH
IN THE CITY OF SEWARD FOR THE PURPOSE OF PAVING STREETS THER
IN, AND PROVIDING FOR THE LEVY>> APPORTIONMENT AND ASSESSMENT
AND COLLECTION OF THE COST THEREOF AGAINST AND FROM THE
PROPERTY WITHIN SUCH IMPROVEMENT DISTRICT: DETERMINING
GENERALLY WHAT WORK SHALL BE DONE AT THE EXPENSE OF THE
OWNERS OF THE ADJOlNING~ CONTIGUOUS OR PROXIMATE PROPERTY~
OR NON -CONTIGUOUS AND OTHER PROPERTIES WITHIN SUCH IMPROVE-
MENT DISTRICT SPECIALLY BENEFITTED THEREBY.. AND PROVIDING
GENERALL Y FOR THE MANNER OF MAKING~ APPORTIONING AND COL-
LECTING ASSESSMENTS THEREFOR.
BE IT ORDAINED by the City Council of the City of Seward~ Alaska:
That the following street improvement district for the purpose of
paving with asphalt pavement and the necessary earthwork, installation of
drainage facilities, sidewalks. and other necessary work in connection there-
with, is hereby established:
STREET IMPROVEMENT DISTRICT NO. 1
All and the whole of the area. parcels and tracts of land located in the
Original Townsite of the City of Seward. Alaska, and more particularly
described as follows:
Lots 1 through 11 of Block 2
Lots 1 through 7, and Lots 32 through 40 of Block 3
Lots 1 and 2. and Lots 37 through 40 of Block 4
Lots 21 through 40 of Block 8
Lots 1 through 40 of Block 9
Lots 1 through 40 of Block 10
Lots 1 through 20 of Block 11
Lots 1 through 20 of Block 14
Lots 1 through 40 of Block 15
Lots 21 through 40 and Lots 16 through 20 of Block 16
Lots 21 through 25 of Block 17
Lots 21 through 40 of Block 23
Lots 1 through 40 of Block 24
Lots 1 through 20 of Block 25

Federal Addition to the Original Townsite of Seward, Alaska~ and more
particularly described as follows:

Laubner Addition to the Original Townsite of Seward, Alaska, and more
particularly described as follows:

Lots 4 through 20 of Block 10
All and the whole of the area, parcels and tracts of land located in
that portion of the Alaska Railroad Terminal Reserve lying South of Railway
Avenue, beginning at a point where the West line of Third Avenue intersects
the Southerly boundary line of Railway Avenue, thence in a Northeasterly
direction along said Southerly boundary line of Railway Avenue to a point
where the East boundary line of Fifth Avenue intersects with the Southerly
boundary line of Railway Avenue, thence North across said Railway Avenue
along the East boundary line of Fifth Avenue to the Northerly boundary of
Railway Avenue, thence Southwesterly along said Northerly boundary of Rail-
way Avenue to the West boundary line of Third Avenue, thence South across
said Railway Avenue along the West boundary line of Third Avenue to the
point of beginning.
All and the whole of the area, parcels and tracts of land located in
that porti.on of the Alaska Railroad Terminal Reserve lying East of the East
boundary line of D Street.
All of said descriptions being in accordance with the official maps and
plats on file in the office of the U. S. Commissioner at Seward, Alaska.
The street improvements that shall be performed within Street
Improvement District No. 1 shall consist of the following:
The hereinafter described area shall be paved with asphaltic pave-
ment, and the necessary earthwork installation of drainage facilities, storm
sewers, gutters, sidewalks and other necessary work in connection with said
paving, said area being as follows:
Beginning at Third Avenue and Railway Avenue, thence along Railway
Avenue to Fifth Avenue, thence North along Fifth Avenue to 150 feet beyond
the intersection of Fifth Avenue and Adams Street; Third Avenue from Rail-
way Avenue to Adams Street; Fourth avenue from Railway Avenue to Jeffer-
son Street; Washington Street from Third Avenue to Fifth Street; and Adams
Street from Third A venue to Fifth Street.
The hereinafter described area shall be strip paving with asphaltic
pavement, and the necessary earthwork# installation of drainage facilities,
and other necessary work in connection with said paving, said area being as
follows:

Beginning at the intersection of Third Avenue and Adams Street on
Third Avenue to the Lagoon Road; and on Fourth Avenue beginning at the
intersection of Fourth Avenue an~LJeffersort Street along Fourth Avenue to D
Street, thence West on D Street to Third Avenue.
The approximate costs of said improvements in this district as hereto-
fore described is Five Hundred Seventy-one Thousand Three Hundred and
no/IOO Dollars ($571,300.00), fifty percent of the cost of which shall be borne
by the City of Seward, and fifty percent of said cost is to be paid through the
Alaska Public Works, under Project No. Aaa 50-A-182, and Two-thirds (2/3)
of the cost of said improvement to the City of Seward, shall be assessed
against the owners of the property located therein, in the manner hereinafter
provided, and One-third (l/3) thereof shall be paid from the general fund of
the City of Seward.
Two-thirds (2/3) of the cost to the city, of the work to be done, and
the improvements to be made, as herein described, in the foregoing des cri-
bed and designated street improvement district shall be at the expense of the
owners of the lots and lands fronting thereon and adjoining, contiguous,
proximate and non-contiguous in the improvement district proximate or
specially benefitted thereby; each lot being separately assessed for the full
debt thereof in proportion to the benefits upon the property thereby benefit-
ted sufficient to cover the total expense of the work. The additional One-
third (l/3) of the cost to the city of the work to be done, and the improvements
to be made, shall be at the expense of the City of Seward.
The plans for the work and the estimates of the cost of the same in
said improvement district herein described, and the plat of said improvement
district, with the various lots, tracts and parcels of land that are included
therein and affected thereby, together with a list of said various tracts, lots
and parcels of land and the estimated cost of said improvements in said im-
provement district, herein created, that will be assessed against each such
lot, tract or parcel within said improvement district herein created, is on
file in the office of the City Assessor, City Hall, Seward Alaska, and are
open for inspection by anyone desiring to inspect the same.
This ordinance, after passage, shall be published at least once a week
for two consecutive weeks in a newspaper published within the corporate
limits of the City of Seward, and such publication is hereby designated as
public notice to all persons concerned of the nature, extent and approximate
cost of the improvements to be made in said improvement district, and the
boundary of the said improvement district, to which the cost of the improve-
ments of said improvement district will be assessed. Further nell tice is
hereby given to all persons and parties concerned that any person owning
property affected by said improvement district as herein established, shall
have sixty days from the first publication hereof in which to file their objec-
tions to the work proposed to be performed within the said improvement
district. Five (5) days or more after the termination of the sixty (60) day
period from and after the first publication of this notice, the work proposed
to be performed in said improvement district will commence, unless objec-
tion be filed either severally or by petition by the owners of property bear-
ing fifty percent (500/0) or more of the estimated cost of said improvement or
improvements in the said improvement district.
Publication hereof shall be made by posting a copy of this Ordinance
on the City Hall Bulletin Board for at least ten (10) days following the pas-
sage and approval hereof.
