HomeMy WebLinkAboutOrd1957-278 CI'l'i OF :::;~;,i:iD ()RD.l:'J,<~~Cl~ = ~(). 27:3 AN ORDINANCE CLARIFYING AND RESTATING TAX ORDINACE NO. 190-A AS AMENDED BY TAX ORDINANCE NO. 267 PROVIDING FOR THE LEVY AND COL- LECTION OF A CONSUMER'S SALES TAX OF 2 PER CENT OF THE SELLING PRICE ON ALL RETAIL SALES AND SERVICES OF 25 CENTS AND MORE MADE WITHIN THE CITY OF SEWARD, ALASKA, PROCEEDS THEREOF TO BE PLACED IN A SPECIAL PURPOSE ACCOUNT TO BE USED FOR SAID SPECIAL PURPOSE; 'PROVIDING FOR ADMINISTRATION AND METHODS OF COLLECTION OF SUCH TAX; PROVIDING PENALTIES; FOR OTHER RELA TJ:D PURPOSES; AND INDICATING AN ' : INTENT TO AMEND TAX ORDINANCE NO. 190-A. WHEREAS, a special election was called and held in conformity ,and under the provisions of subsection Ninth, Section 16 1-35, ACLA 1949, as amended by Section 1, Chapter 38 of the Session Laws of Alaska, 1949, on the 8th day of September, 1949. and at said elec- tion more than 55% of the qualified voters of the City of Seward, Alaska, voting thereat voted in favor of a 2% consumer's sales tax on retail sales and services made within the City of Seward, and WHEREAS, the City Council of the City of Seward on the 23rd of September, 1949, enacted a consumer's sales tax by the passage of Tax Ordinance No. 190-A for the purpose of providing additional funds for the construction and operation of more adequate education- ,al and public health facilities and to provide betterment of schools and to pay for such school obligations, public health and sanita- tion, and I I \oJHEREAS, the City Council of the City of Seward has determined that Tax Ordinance No. 190-A as amended by Tax Ordinance No. 267 should be completely amended, revised and restated in order to !clearlY state the intent of the City Council with respect to inter- I I'pretation of the above ordinances, NOW, THEREFORE, I, I BE IT ORDAINED By the City Council of the City of Seward, IAlaska: I , \ SECTION 1. The heading and whereas clauses of Tax Ordinance , 'liNo. 267 are hereby repealed. SECTION 2. From and after the effective date of this Ordinance , I'the " , as consumer's sales tax for the City of Seward shall be the same provided for in Sections 1 through 11 df Tax Ordinance No. 190-A ~s amended by Tax Ordinance No. 267. SECTION 3. I lordinance No. 190-A entitled "Partial Invalidity" is hereby amended I Ito read: If any section, subsection, sentence, clause, or phrase of this Section 12 of Tax Ordinance No. 267 amending Tax Ordinance is held to be invalid, the decision shall not affect the the validity or meaning of the remaining portions of this Ordinance~ -..-~ The City Council declares that it would have passed this Ordinance, I and each section, subsection, clause, phrase thereof, irrespective I of the fact that anyone or more sections, subsections, sentences" clauses, or phrases be declared invalid. All ordinances and parts of Ordinances in conflict with this Ordinance are hereby repealed, provided, however, that any taxes now due and payable under said Ordinance 190-A before amendment, and said Ordinance 190-A as amended by Ordinance 267 shall be paid !as therein provided. This Ordinance shall be constructed as an amendment to Tax 'Ordinance 190-A as amended by Tax Ordinance 267.
