" j; ''j, ORDINANCE 134 AN ORDIN1JJCE TO REGUL.ATE TIill CLOSING HOURS FOR LIQUOR RETAIL STORES .AND BEER AND WINE DISPENSARIES AND RESTAURANTS DISPENS- ING BEER PiND WINE J,O REGUlJ1.TE THE CLOSING HOURS ON MUSIC IN RESTAURANTS PJ..TD EM!{ AND 'NINE DISPENSARIES llliD PROVIDING PENAL- TIES FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE, AND FOR OTHER PURPOSES. ------------------ BE IT ORDAI~"ED BY THE COMMON COUNCIL OF THE TO'NN CF SE\'lARD, ALASKA: Section 1. Closed Period. Any person, persons, firm or CorporatIon owning or having in charee or under their care, a beer or wine dispensary, liquor retaIl store or restaurant where beer and wine are dispensed in the incorporate limits of the Town of Seward, Alaska, shall in every twenty-four hour diY ob- serve a closed veriod on the sale of liquor, and beer and or wine from one oiclock A.M. to six o'clock A.M. Section 2. Any person persons, firm or Corporating own- ing or havin~ in charge or under their care any restaurant in the To~m of ~eward, shall not serve any beer andlor wine unless the same be served with a bona fide meal or lunch, for ~ich a charge has been made. Section 3. Enforcement: Duties of Officers. It shall be the duty of the Police Department of the 10wn of Seward, and the Police Committee of the Common Council, to enforce the privis- ions of this Ordinance. Section 4. Closed Period. Any person, persons, firm or Co~oratlon ownIng or havIng In charge or under their care in a public place of business in the Town of Seward any musical In- strument or music of any kind, shall in every twenty-four hour day observe a closed period on said music from twelve o'clock midnight to six o'clock A.M. Section 5. It shall be unlawful to place or maintain cur- tains or other obstructions which shall prevent a clear view of a public bar from the streets. Section 6. No licensee shall sell, give, exchange, or permit to be sold, given or exchanged whiskey, or other hard li- quors by the drink or glass, or from any flask, bottle or other receptacle upon which the seals thereon shall haTe been or are broken. Section 7. That, in addition to panalties hereinafter prescribed for the violations of the provisions of this Ordinance, the Common Council of the Town of Seward, Alaska, may in its dis- cretion, ID8ke recommendation to the District Court for the Ter- ritory of Alaska, Third Division, for a revocation of the license issued to any violator of the provisions of this Ordinance. Section 8. Penalties for Violatlon. ' .., #2-0rdinance 134 thereof, ~hall b~ punished by a fine of not more than One Hundred Dollars (,100.00) or imprisonment not to exceed ninety days, or by both such fine and imprisonment. Section 9. This Ordinance shall take effect and be in force on the 1st day of December, 1937, and shall be published once in the Seward Gatewayo PASSED under suspension of the Rules, and APPROVED this 15th day of November, 1 9 3 7. c~\~ Municipal Cler~ CCu~4~or -2-
