AN ORUINABCE AUTHORIZING THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SEWARD, ALASKA, Tu EXCHANGE A ROAD RIGHT OF WAY OF FIRST AVENUE ABUTTING
LOTS 1 TO 18 INCLUSIVE OF BLOgK 1 BAYVIEW ADDITION, A FORTY FOOT RIGHT
OF ,lAY APPOXIMATELY .74 ACRES FOR AN ID\.ISTING ROAD RIJHT OF WAY COM-
MENCING 1..T "B" STREET INTERSECTION IN THE BAYVIEW ADDITION AND JOINING
THE LAGOON ROAD A DISTANCE OF APPOXI~\TELY 1654.4 FZET OF FORTY FOOT
RIGHT OF WAY CONTAINING APPOXIi~TELY 1.5 ACRES, OWNED BY HERMAN LEIRER.
THE ABun DESORIBED PORTION OF FIRST AVENUE AS SHOWN ON THE MAP AND PUT
OP THE CITY OF SE/IARD, ALASKA, BAYVIEW ADDITION, IS SITUATED ALONG THE
BASE OF HARTHON MOUNTAIN AND THE COST OF CUTTING THIS ROADWAY THROUGH
AND SUR~AOING IT WOULD BS PROHIBITIVE.
BE IT ORDAINED: By the Common Council of the City of Seward,
Alaska;
SECTION 1. That the mity of Seward, Alaska, is the absolute
owner of a forty (40) foot uncut road right of way running on !t~st
Avenue of the said town abutting Lots one (1) to eighteen (18) inclusive
of Block one (1) of Bayview Addition in the Town of Seward, Alaska,
appoximately eight hundred ten (810) feet in length and cont?ining
appoximetely seventy-four hundredths (.74) of one acrej and legally
described 8S follows:
"An uncut r:Jsd right of way forty (40) feet wide,
commencing at lot one (1) Block one (1) of Bayview
Addition to the Town of Seward abutting "A" Street
and ending at Lot eighteen (18) Block one (1) of the
Bayview Adctition, a distance of eight hundred ten (810)
feet; as per plat dated 1947 & 1948 by William H.
Estes with registered #170-52.<<
SECTION 2. That Herman Leirer is the absolute owner of 0 forty
(40) foot existing road right of wsy cOllunencing at "Sll Str"let inters-
ection wit8 First Avenue of Bayview Addition in the Town of Seward
running thence east and south and east joining with the Lagoon Road
a total distance of appoximetely sixteen hundred fifty four and four
tenths (1654.4) feet containing appoximately one and one half acr~s
(1.5); and legAlly described as follows:
"In Bayvlew Addition of the 'fawn of Seward c(Jmrnpn~ing
at 8 point sixty-three and seven tenths (63.7) feet South of
a concrete monument at the junctjn" 0f "nIl Street and First Avenue,
thence four hundred seventy three and three te!'t~s (4.73.3) feet South
twenty eight degr~oc fix ~inutes ~a3t (S28-e6E), thence sixty nine and
four tenths (69.4) feet South thirty nine degrees thirtytflio.. minutes

thence three hundred ei~hty nine (389) feet North eighty nine degrees

thence fi,ty eight and one tenths (58.1) feet South ceventeen degrees
forty one-minutes East (S17-41E), thence five hundred eig(hteen and qicrt
tenths (518.8) feet South three degrees one ~inute West S3-1W) to
Southpoint, thence sixtp four (64) feet South fifty one degrees nine
minutes West (S51-9W) joining Lagoon ROAd, 3 1i2~~~ce of sixteen hundred
fifty four and four tenths (1654.4) feet, ell contained within United
Stat os E-urvey No. 241."
SECTION 3 . It is for the best interests of the City of Seward
that the right of w~y now owned by the City of Seward be exchanged for
the right of way now owned by Herman Leirer; and that the mayor and
city clerk are hereby authorized and directed to make a Warranty Deed
of the right of way now owned by the city and described in Saction 1.
of this ordinance to Herman Leirer upon receipt from him of a Warranty
Deed of the right of way described in Section 2. of this ordinance
without other consideration than such exchange of Deeds.
