RESOLUTION NO. 86-38
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUI'HORIZING THE NON-(X)MpETITIVE NEGOI'IATED
SALE OF CITY CWNED GRAVEL RESaJRCES 'ID ALASKA BRICK COMPANY
WHEREAS, the City of Seward has begun construction of the
Spring Creek Correctional Facility in the Fourth of July Creek Valley;
and
WHEREAS, a large aIrOunt of concrete aggregate is required for
the precast panels used in the construction; and
WHEREAS, Alaska Brick Corrpany, subcontractor to the prine.ry
contractor, Sarrwhan America, has tested a number of gravel sources in
the Seward area which proved to be either inadequate or too far away
from the construction site; and
WHEREAS, the City of Seward has a large volurre of excess
gravel stored on site at the nearby Seward Marine Industrial Center
which is not committed to any other use; and
WHEREAS, this gravel source has been tested and rreets the
criteria required for aggregate; and
WHEREAS, Alaska Brick Corrpany has offered to purchase screened
3/4 minus gravel at $0.85 per ton from the City of Seward; and
WHEREAS, the price offered is in line with values of other
gravel sources throughout the Kenai Peninsula;
NCW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The public interest would best be served by not
requull1g corrpetiti ve bidding on the sale of approxine.tel y 10,000 yards
of sand and 3/4 minus gravel.
Section 2. The City Manager is authorized to sell said gravel
to Alaska Brick Corrpany at a price of $0.85 per ton based on weigh
tickets after the gravel/sand has been extracted from the pit run
stockpile.
Section 3. During the time that Alaska Brick Corrpany is
extracting sand and gravel fran the City's stockpile, its batch plant
may remain in place at no cost. Beginning October 1, 1986, such use of
property will, pursuant to approval of a lease agreerrent, be charged at
the rate of $0.10 per square foot per annum in addition to the cost of
the sand and gravel.

Section 4. This resolution shall take effect imrrediately upon
its adoption.
