RESOIlJTION NO. 86-43
A RESOIlJTION OF 'mE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, FOR THE PURPOSE OF FUNDING ADDITIONS TO
OFFSITE IMPROVEMENTS FOR GATEWAY SUBDIVISION
WHEREAS, the City Council, by adoption of Resolution No.
84-65, has approved transfer of the Cateway Subdivision property to
Gateway Ventures, Inc., and
WHEREAS, Cateway Ventures has constructed certain off site
improverrents, pursuant to the agreerrents between the City and Cateway
Ventures, for which the City has reimbursed Gateway Ventures, Inc., and
WHEREAS, the City Council, by adoption of Resolution No. 84-52
and Resolution No. 86-18, has appropriated $750,317.64 for the purpose
of funding offsite improverrents constructed as a part of the developITent
of Gateway Subdivision; and
WHEREAS, change order number 5 totalling $5,082.23 for the
cost of an offsite drainage ditch at the intersection of Bear Drive and
Phoenix Road was approved on May 12, 1986; and
WHEREAS, Gateway Ventures is requesting reimburserrent of 12%
of the cost of the reservoir improverrents totalling $40,877.72, which
Cateway Ventures has agreed to reimburse the City through an assessnent
district created from the remaining unsold properties of the Cateway
Sul:xlivision; and
WHEREAS, the drainage improverrent and water reservoir reirn-
burSeIlEnt exceeds the approved appropriation of $750,317.64 by approxi-
mately $42,000; and
WHEREAS, the City has funds in the General Fund-Fund Balance
which can be made available for the purpose of neeting the City's
additional obligations pursuant to the agreement authorized by Resolu-
tion No. 84-65;
NO'l, THEREFORE, BE IT RESOLVED BY '!HE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The General Fund-Fund Balance Account No. 101-600-
371-00-00 is hereby decreased by $42,000 and the Cateway Subdivision
Offsite Inproverrent Account No. 299-000-368-04-00 is hereby increased by
$42,000.

Section 3. This resolution shall take effect imrrediately upon
its adoption.
