<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2000-101 <br /> <br />A RESOLUTION OF mE CITY COUNCIL OF mE CITY OF SEWARD, <br />ALASKA, AUTHORIZING THE CITY MANAGER TO TRANSFER $20,000 <br />FROM ELECTRIC DEPARTMENT RETAINED EARNINGS ACCOUNT TO <br />THE ELECTRIC DEPARTMENT LEGAL BUDGE, AND AUTHORIZING <br />THE CITY MANAGER TO ENTER INTO A CONTRACTWImKEMPPEL, <br />HUFFMAN AND ELLIS, PC TO PROVIDE LEGAL SERVICES FOR AN <br />AMOUNT NOT-TO-EXCEED $25,000. <br /> <br />WHEREAS, legal expenses for the continued negotiations with Marlow Power and Steam <br />continue to occur; and, <br /> <br />WHEREAS, the Legal firm of Kemp pel, Huffman and Ellis, PC has been retained to assist <br />the City in these negotiations because of their expertise in this particular field; and, <br /> <br />WHEREAS, the same firm of Kemppel, Huffman and Ellis, PC is assisting the City in <br />negotiations with Chugach Electric Association for a renewed power sales contract; and <br /> <br />WHEREAS, the Electric Department Legal Budget has been used up in these negotiations <br />and requires a transfer of $20,000 from Electric Department Retained Earnings; and <br /> <br />WHEREAS, the firm of Kemp pel, Huffman and Ellis, PC has exceed the $10,000 limit: <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section 1. The City Manager is authorized to transfer $20,000 from Electric Department <br />Retained Earnings, Account 501-0000-3050 to the Electric Department Legal Budget, Account 501- <br />5400-5170. <br /> <br />Section 2. The City Manager is authorized to enter into a contract with Kemppel, Huffman <br />and Ellis, PC for legal services not-to-exceed $25000. <br /> <br />Section 3. This resolution shall take effect immediately upon its adoption. <br /> <br />PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 11 th day <br />of September, 2000. <br />
