<br />Sponsored by: Yoder <br /> <br />.... <br /> <br />CITY OF SEWARD, ALASKA <br />PLANNING AND ZONING COMMISSION <br />RESOLUTION 2007-06 <br /> <br />A RESOLUTION OF THE SEWARD PLANNING AND ZONING <br />COMMISSION OF THE CITY OF SEWARD, ALASKA, <br />RECOMMENDING THE SEWARD CITY COUNCIL APPROVE <br />THE V ACA TION OF "B" STREET BETWEEN FIRST A VENUE <br />AND SECOND AVENUE AND CONVEY TITLE TO THE STATE <br />OF ALASKA (A VTEC) FOR EDUCATIONAL FACILITIES. <br /> <br />WHEREAS, the State of Alaska through the Alaska Vocational Technical Center <br />(A VTEC) has formally requested the vacation of"B" Street to consolidate the ownership <br />of the property underlying their educational campus~ and <br /> <br />WHEREAS, the Seward Common Council adopted Resolution No. 49 in 1954 to <br />vacate the subject portion of"B" Street (First Ave. to Second Ave.) but the vacation was <br />never perfected; and <br /> <br />WHEREAS, the subject portion of "B" Street and adjacent land has been <br />occupied with educational facility (old high school) starting in the mid-fifties; and <br /> <br />.... <br /> <br />WHEREAS, the "B" Street right-of-way was established during the original <br />platting of the Federal Addition of the Original Townsite of Seward~ and <br /> <br />WHEREAS, the City of Seward after public hearing finds that there is no longer <br />a public interest in preserving that portion of the "B" Street right-of-way for access <br />purposes since it is occupied with structures and is not used for local motorized or <br />pedestrian access purposes. Public utilities exist across and/or within the subject right of <br />way as well as drainage features that will require field location, verification and <br />corresponding easements for their preservation and maintenance; and <br /> <br />WHEREAS, The adjoining property owners are the State of Alaska (Block 15) <br />and the City of Seward (Block 6) and both parties have agreed to convey title of the <br />entire subject right-of-way to the State for educational purposes; and <br /> <br />WHEREAS, The street vacation, as proposed, is in the public's interest; and <br /> <br />WHEREAS, having complied with the public notification process; on April 5th, <br />2007, the Seward Planning and Zoning Commission held the required public hearing on <br />the request for street vacation. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning <br />Commission that <br /> <br />.... <br />
