Sponsored by: Oates <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2009-088 <br />A RESOLUTION OF THE CITY COUNCIL OF SEWARD, ALASKA, <br />AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT <br />WITH HARMON CONSTRUCTION FOR CONSTRUCTION OF A NEW <br />SAND SHED FOR AN AMOUNT NOT TO EXCEED $124,692, AND <br />APPROPRIATING FUNDS <br />WHEREAS, the public works sand shed sustained critical damage when the south wall was <br />hit by the D-6 dozer while working within the structure causing the concrete wall to crumble; and <br />WHEREAS, as a result of the damage the City's insurance company has agreed to pay <br />$90,000 toward the cost of replacing the structure; and <br />WHEREAS, failure to immediately begin reconstruction of the sand shed to beat the winter <br />freeze, will result in the City being without an adequate storage facility until the spring, and the <br />public works department investigated the possibility of renting space for sand storage from Metco <br />and that option was not available; and <br />WHEREAS, staff solicited quotes from contractors capable of immediately reconstructing <br />the storage shed within the City's required timeline, and the lowest bid was from Harmon <br />..~.. <br />Construction in the amount of $124,692, with said bid resulting in a structure which will be partially <br />moveable at a future date, and the administration recommends award of a contract to Harmon <br />Construction; and <br />WHEREAS, Seward City Code 6.10.120(a)(2). Specialized products and professional <br />services exempt provides for a waiver from the standard procurement provisions in the case where <br />"an emergency makes the delay incident to competitive bidding unreasonable." <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA that: <br />Section 1. The city manager is hereby authorized to enter into a contract with Harmon <br />Construction in an amount not to exceed $124,692, in substantially the form as attached hereto. <br />Section 2. The Seward City Council hereby waives the competitive procurement requires in <br />accordance with the above recitals which are incorporated herein, and considers this procurement to <br />be an emergency which makes the delay incident to competitive bidding unreasonable. <br />Section 3. Funding in the amount of $124,692 is appropriated as follows: $90,000 from <br />insurance proceeds account no. 101-0000-4630 and $34,692 from the General Fund reserves account <br />no. 101-0000-3050, to the Capital Acquisition Fund account no. 103-1030-5910. <br />
