Sponsored by: Oates <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2009-092 <br />A RESOLUTION OF THE SEWARD CITY COUNCIL OF THE CITY OF <br />SEWARD, AUTHORIZING A MEMORANDUM OF AGREEMENT WITH <br />THE ALASKA RAILROAD CORPORATION FOR THE PURPOSE OF <br />UTILIZING A STATE LEGISLATIVE GRANT TO DREDGE THE <br />APPROACH AND BERTHING BASINS OF THE ALASKA RAILROAD <br />DOCK TO ACCOMMODATE CRUISE SHIPS <br />WHEREAS, the City of Seward was awarded a FY 2010 Designated Legislative Grant <br />in the amount of $4,500,000 to dredge the cruise ship berthing and approach basins; and <br />WHEREAS, the City intends to work with the Alaska Railroad Corporation to <br />accomplish the dredging project in order to improve safety and better meet cruise ship passenger <br />needs in Seward; and <br />WHEREAS, the administration has worked with the Alaska Railroad Corporation to <br />develop the terms of a Memorandum of Agreement as attached hereto, which allows the City to <br />contract with ARRC to accomplish the entire scope of the project through a Reimbursable <br />Services Agreement or alternatively, to allow the City to pay the costs incurred by the railroad, <br />during the course of the project; and <br />WHEREAS, the City intends to receive up to 10% of the grant proceeds to offset the <br />City's costs of the project. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SEWARD, ALASKA that: <br />Section 1. The City Council hereby approves the Memorandum of Agreement between <br />the City of Seward and the Alaska Railroad Corporation in substantial form as attached hereto, <br />and authorizes the city manager to amend as necessary, the specific terms of the Agreement, <br />inasmuch as said revisions do not alter the material terms of the Agreement. <br />Section 2. This resolution shall take effect immediately upon its adoption. <br />PASSED AND APPROVED by the City Council of the City of Seward this 28`'' day of <br />September, 2009. <br />
