Sponsored by: Phillip Oates <br /> CITY OF SEWARD, ALASKA <br /> RESOLUTION 2010 -072 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br /> ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br /> AMENDMENT TO THE QUARRY AGREEMENT WITH WEST <br /> CONSTRUCTION COMPANY TO ALLOW PAYMENT IN KIND OF CLASS <br /> III AND CLASS II RIPRAP <br /> WHEREAS, on February 22, 2010 the Seward City Council approved an Agreement with <br /> West Construction Company to remove rock from the City's quarry for use in extending the <br /> breakwater at the Small Boat Harbor; and <br /> WHEREAS, West has the equipment and expertise to produce Class III and Class II riprap <br /> that the City could use for future projects; and <br /> WHEREAS, the parties agree that payment of the $97,000 owed by West to the City under <br /> the Agreement could be paid by producing an equivalent value of Class III and Class II riprap for the <br /> City; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF SEWARD, ALASKA that: <br /> Section 1. The City Manager is authorized to enter into an amendment, in substantially the <br /> form presented at this meeting, to the Agreement between the City of Seward and West Construction <br /> Company dated Athazil 22, 2010 for the purpose of amending the method of payment. <br /> Fe-1D. <br /> Section 2. This resolution shall take affect immediately upon its adoption. <br /> PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 2nd day of <br /> August, 2010. <br /> THE CITY OF WARD, ALASKA <br /> 4 <br /> Willard E.
