Sponsored by: Shafer and Terry <br /> CITY OF SEWARD, ALASKA <br /> RESOLUTION 2012 -019 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br /> ALASKA, CENSURING MAYOR SEAWARD FOR THE VIOLATION IN HIS <br /> DUTY OF OBEDIENCE AND DUTY OF LOYALTY TO FAITHFULLY <br /> REPRESENT THE PUBLIC'S 2012 CITY OF SEWARD STATE <br /> LEGISLATIVE PRIORITIES AS APPROVED IN RESOLUTION 2011 -083 <br /> WHEREAS, the Mayor presides at all meetings of the Council and is recognized as the head <br /> of the City for all ceremonial purposes; and <br /> WHEREAS, the Mayor has no regular administrative or executive duties; and <br /> WHEREAS, each Council Member, including the Mayor, has the right to sway the Council <br /> to his or her point of view, and if a member votes with the losing side, the member must respect the <br /> fact that the majority rules and cheerfully carry out the Council's wishes for the benefit of the citizens <br /> of Seward; and <br /> WHEREAS, the Duty of Obedience requires Council, including the Mayor, to act in <br /> accordance with the Seward City Charter, Code of Ordinances, Council Rules of Procedure, and <br /> Resolutions; and forbids acts outside the scope of Council powers; and <br /> WHEREAS, when speaking as an elected representative of the City of Seward, the Mayor <br /> must speak consistently with the policy and objectives adopted by City Council on behalf of the <br /> citizens of Seward; and <br /> WHEREAS, during Mayor Seaward's legislative trip to Juneau, he disregarded the Council's <br /> will, thus disobeying the public's wishes, and substituted his own by promoting the Friends of the <br /> Jesse Lee Home as a City of Seward 2012 State Priority; and <br /> WHEREAS, this reprimand is being enacted with the hopes of reforming and educating <br /> Mayor Seaward so that he won't behave in the same way again; and <br /> WHEREAS, Council Members desire to move forward in a spirit of cooperation with the <br /> Mayor for the benefit of the citizens of Seward. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF SEWARD, ALASKA that: <br /> Section 1. Mayor Seaward is restricted from traveling on City business for six months from <br /> enactment of this resolution. <br />
