Sponsored by: Hunt <br /> CITY OF SEWARD, ALASKA <br /> RESOLUTION 2012 -048 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br /> ALASKA, APPROVING THE SUBMITTAL OF THE KENAI PENINSULA <br /> BOROUGH PETITION TO VACATE AND RECOMMENDING THE <br /> APPROVAL OF THE VACATION OF THE 200 FOOT NUMBER 3 WATER <br /> WELL EASEMENT LOCATED IN THE FORT RAYMOND SUBDIVISION, <br /> SOUTH OF SEA LION DRIVE <br /> WHEREAS, the Fort Raymond Subdivision 86 -10 dedicated four (4) public water well <br /> easement of 200 feet each; and <br /> WHEREAS, water well number 3 has been officially decommissioned and abandoned in <br /> place; and <br /> WHEREAS, the 200 foot water well easement for well number 3 is no longer necessary; and <br /> WHEREAS, Kenai Peninsula Borough Code 20.28.100 requires the consent of the City <br /> Council to vacate any easement located within the City; and <br /> WHEREAS, Seward City Code 7.05.510 (D) allows the City Manager, at the direction of the <br /> City Council, to relinquish any real property easement, whenever the interest is no longer used or <br /> needed. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF SEWARD, ALASKA that: <br /> Section 1. The Seward City Council hereby directs the City Manager to submit the Kenai <br /> Peninsula Borough Planning Commission application to vacate the 200 foot Number 3 water well <br /> easement dedicated by the Fort Raymond Subdivision, 86-10. <br /> Section 2. The Seward City Council further recommends the Kenai Peninsula Borough <br /> Planning Commission approve the vacation of the 200 foot Number 3 water well easement dedicated <br /> by the Fort Raymond Subdivision, 86 -10 . <br /> Section 3. This resolution shall take effect 30 days after passage and posting as required by <br /> Seward City Code § 7.05.145. <br /> PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 9th day of <br /> July. <br />
