Sponsored by: Hunt <br /> CITY OF SEWARD, ALASKA <br /> RESOLUTION 2014-092 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br /> ALASKA, REVISING SECTIONS 200 AND 205 OF THE HARBOR <br /> TARIFF IN ORDER TO REVISE BILLING PRACTICES TO MEET <br /> INTERNAL REVENUE SERVICE COMPLIANCE FOR TAX-EXEMPT <br /> REVENUE BONDS <br /> WHEREAS, in the process of re-financing Harbor Revenue Bonds the city learned from <br /> Bond Counsel that Internal Revenue Service rules for Tax-Exempt Revenue Bonds require a <br /> change in harbor billing and moorage renewal rules; and <br /> WHEREAS, the harbor in the past has offered customers the option to renew moorage <br /> for up to one year at a time; and <br /> WHEREAS, the harbor can meet the IRS rules by limiting renewal contracts to six <br /> months; and <br /> WHEREAS, it is necessary for the city to revise the Harbor Tariff to comply with the <br /> IRS requirements; and <br /> WHEREAS, this amendment also includes a technical change of ownership of the <br /> shiplift from Seward Ship's Drydock to Vigor Alaska. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF SEWARD, ALASKA that: <br /> Section 1. These forms include, but <br /> are not limited to, Vessel Moorage Application, and supplements thereto; Application and <br /> Agreement for Reserved Moorage; Application and Agreement for Transient Moorage; Boat Lift <br /> Agreement; Vessel Shiplift Use Application, and Supplements thereto; Shiplift System Use <br /> Permit; Terminal Use Permit; Prepayment Agreement; and Uplands Storage Agreement. <br />
