<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2001-025 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br />ALASKA, AUTHORIZING THE CITY MANAGER TO ADJUST THE <br />ALASKA RAILROAD CORPORATION'S WATER BILL FROM $10.00 <br />PER 1,000 GALLONS TO $4.25 PER 1,000 GALLONS RETROACTIVE <br />TO MAY 1, 1998 AND ISSUE A REFUND FOR THE OVERPAYMENT OF <br />$24,127.78 <br /> <br />WHEREAS, Council approved a ship water tariff for temporarily moored vessels at <br />$3.03 per 1,000 gallons effective July 1, 1993; and <br /> <br />WHEREAS, due to additional costs of manpower for delivering water to temporarily <br />moored vessels, Council approved a ship water tariff for temporarily moored vessels at $10.00 <br />per 1,000 gallons effective May 1, 1995; and <br /> <br />WHEREAS, the water rate for the Alaska Railroad Corporation's (ARRC) cruise ship <br />water was not changed to the $10.00 rate until May 1, 1998 after a routine review of customers' <br />bills revealed that the ARRC's ship water rate had not been changed in 1995; and <br /> <br />WHEREAS, the ARRC disputed the new water rate of$10.00 per 1,000 gallons in 1998; <br /> <br />and <br /> <br />WHEREAS, it was not the City's intention to change the ARRC's water rate when the <br />rate for temporarily moored vessels was changed to $10.00 as the ARRC has a direct water <br />connection that does not require additional manpower; and <br /> <br />WHEREAS, a new rate study approved by Council established a new ship water tariff of <br />$4.25 with additional charges for any assistance required for temporarily moored vessels <br />effective May 1, 1999; and <br /> <br />WHEREAS, based on the ship water rate study conducted in 1999 that set the rates for <br />ship water at $4.25 per 1,000 gallons, the administration has reached an agreement with the <br />ARRC that would require the ARRC to pay the $4.25 rate from May, 1998 instead of the $10.00 <br />rate; and <br /> <br />WHEREAS, the agreement between the City and the ARRC is fair and equitable and <br />charges the rate based on a the most recent rate study that has determined that the City will <br />recover it's costs for ship water from the ARRC at the new rate of$4.25 per 1,000 gallons. <br />
