<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2001-026 <br /> <br />A RESOLUTION OFTHE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, <br />AUTHORIZING THE CITY MANAGER TO ENTER INTO A MEMORANDUM OF <br />UNDERST ANDING WITH THE LOWELL POINT COMMUNITY COUNCIL <br />(LPCC) ALLOWING, UNDER CERTAIN CONDITIONS, A CONNECTION <br />BETWEEN THE LPCC W ASTEW ATER SYSTEM AND THE CITY OF SEWARD <br />W ASTEW ATER TREATMENT PLANT <br /> <br />WHEREAS, the Lowell Point Community Council (LPCC) is seeking funding from the <br />Alaska Department of Conservation (ADC), Village Safe Water program, to design a wastewater <br />system for the Lowell Point area; and, <br /> <br />WHEREAS, LPCC has requested permission to connect their wastewater system to the City <br />of Seward Sewage Treatment Plant at Lowell Point; and, <br /> <br />WHEREAS, if the Lowell Point Community was included inside the City of Seward City <br />Limits the funding from the Village Safe Water program would not be available; and, <br /> <br />WHEREAS, the Memorandum of Understanding includes conditions which protect the City <br />of Seward from having to spend capital or maintenance funds to accommodate this request and <br />provides for certain other conditions to protect the City of Seward; and, <br /> <br />WHEREAS, LPCC must obtain the approval ofthe City of Seward for the interconnection <br />in order to qualify for funding under the Village Safe Water Program. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section 1. The City Manager is authorized to enter into an agreement (Attachment l) with <br />the Lowell Point Community Council to allow interconnection, with certain conditions, of the <br />LPCC wastewater system and the City of Seward Sewage Treatment Plant. <br /> <br />Section 2. This resolution shall take effect immediately upon its adoption. <br /> <br />PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 12th <br />day of February 2001. <br />
