<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2001-040 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br />ALASKA, AUTHORIZING THE COMPLETION OF THE FORECLOSURE <br />PROCESS AND OBTAINING A CLERK'S DEED FOR THE JESSE LEE <br />HOME PROPERTY AND APPROPRIATING $50,000 TO SECURE THE <br />PROPERTY <br /> <br />WHEREAS, in 1995 the City of Seward filed a foreclosure action on the Jesse Lee Home <br />property (Lots 15A and 15B, Jesse Lee Heights Subdivision Addition No.4) for unpaid assessments <br />and associated penalties and interest Following that, the City and the property owner entered into <br />an agreement that would have discharged the property assessments if restoration and redevelopment <br />of the historic structures on the property were completed. That agreement expired on September 30, <br />2000, the restoration and redevelopment of the Jesse Lee Home has not been accomplished, and the <br />City is now in a position to complete the foreclosure process and obtain the property; and <br /> <br />WHEREAS, the Kenai Peninsula Borough has also initiated foreclosure on the Jesse Lee <br />Home property for delinquent property taxes; and <br /> <br />WHEREAS, the State Legislature has introduced a bill which would enable the State to <br />acquire the Jesse Lee Home property, and manage it in a way that recognizes its contribution to the <br />State's history; and <br /> <br />WHEREAS, the Seward Historic Preservation Plan recommends that the City continue to <br />monitor the status of the Jesse Lee Home and support efforts to save it, and the City Strategic Plan <br />encourages the recognition, rehabilitation and preservation of historic sites and buildings; and <br /> <br />WHEREAS, the Seward Planning and Zoning Commission recommends that the City Council <br />complete the foreclosure process and obtain a Clerk's Deed for the Jesse Lee Home property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section L The city manager and city attorney are authorized to take all reasonable steps <br />necessary to complete the foreclosure process and obtain a Clerk's Deed for the Jesse Lee Home <br />property which includes Lots 15A and 15B, Jesse Lee Heights Subdivision Addition No.4. <br /> <br />Section 2. Appropriates $50,000 from the Exxon Oil Spill Litigation funds, account no. 101- <br />0000-4630 to the General Fund, General Services division, Miscellaneous expense, account no. 101- <br />1180-5790 to secure the property from potential liability risks and to pay the costs of publication, title <br />report and other costs as may be necessary to complete the foreclosure process. <br />
