<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: ~ <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2001-117 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br />ALASKA, AMENDING THE PARTICIPATION AGREEMENT WITH THE <br />PUBLIC EMPLOYEES RETIREMENT SYSTEM (PERS), AUTHORIZING <br />THE PARTICIPATION OF THE ELECTED OFFICIALS OF THE CITY OF <br />SEWARD IN THE PERS SYSTEM, AND PAYMENT OF THE REQUIRED <br />PREMIUMS <br /> <br />WHEREAS, prior to August 20, 2000, all compensated elected officials were automatically <br />included in the Public Employees' Retirement System (PERS), per Alaska Statute; and <br /> <br />WHEREAS, the elected officials of the City of Seward have historically been participants in <br />the PERS system, and the City has paid the appropriate premiums to PERS to cover their <br />participation; and <br /> <br />WHEREAS, during the 2000 legislative session, House Bill 335 was passed and signed into <br />law, amending AS 39.35.125 (a), giving political subdivisions the right to determine whether or not <br />to include elected officials in the PERS system; and <br /> <br />WHEREAS, the City Council of the City of Seward desires to continue to provide a fringe <br />benefit to elected officials, by allowing them to participate in the PERS system; and <br /> <br />WHEREAS, the City Council is required to pass a Resolution specifically requesting the <br />inclusion of elected officials in the PERS system, in order for elected officials to be considered eligible <br />for PERS coverage. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section 1. Pursuant to AS 39.35.550 et seq. the City Council of the City of Seward (182) <br />hereby requests that the elected officials of the City of Seward be included in the Public Employees' <br />Retirement System of Alaska. <br /> <br />Section 2. The City of Seward (182) further requests that the inclusion of elected officials <br />in the PERS System of Alaska be made effective, retroactive to August 20, 2000, since the City has <br />continued to submit timely payment of premiums for officials previously considered eligible for PERS <br />coverage, <br />
