<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2001-165 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br />ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE LEASE <br />AMENDMENT NO.1 TO THE SEWARD CHAMBER OF COMMERCE <br />LEASE AGREEMENT FOR THE PROPERTY LOCATED AT 2001 SEWARD <br />HIGHWAY <br /> <br />WHEREAS, the City of Seward leases Lot 4, Fort Raymond Subdivision to the Seward <br />Chamber of Commerce at no cost for a visitor information center/office complex; and <br /> <br />WHEREAS, the initial term of the lease was from September 27, 1989 through June 30, <br />2000; and <br /> <br />WHEREAS, the lease agreement allows for two, five (5) year extensions of the lease subject <br />to all terms and conditions of the lease being reviewed and mutually agreed upon prior to either <br />extension taking effect; and further stipulates that by inaction of the parties, the Lease shall be <br />deemed to continue from month to month; and <br /> <br />WHEREAS, the lease requires that if the lease is extended beyond the initial term, a new <br />lease rate shall be negotiated which takes into consideration the value of the land based upon the <br />current zoning and land use designation; the public contribution of the Chamber operations to the <br />community and site improvements made by Lessee; and <br /> <br />WHEREAS, the Seward Chamber of Commerce has demonstrated its commitment to the <br />residents, visitors and businesses of Seward by developing the property and continuing to promote <br />economic development, tourism and community events; and <br /> <br />WHEREAS, The existing use of the property by the Chamber of Commerce for a visitor <br />information center on Lot 4, Fort Raymond Subdivision is compatible with the existing Institutional <br />Land Use Plan and Zoning designation of the property; and <br /> <br />WHEREAS, the City has no other plans, nor foresees a higher and better public use of Lot <br />4, Fort Raymond Subdivision. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section 1. The recitals are hereby incorporated by reference. The City Council finds that it <br />is in the public interest to extend the Seward Chamber of Commerce Lease Agreement until June <br />30, 2005 as provided for in the lease agreement. <br />
