<br />Sponsored by: Applicants <br /> <br />CITY OF SEWARD, ALASKA <br />PLANNING AND ZONING COMMISSION <br />RESOLUTION 2003-18 <br /> <br />A RESOLUTION OF THE SEWARD PLANNING AND ZONING <br />COMMISSION OF THE CITY OF SEWARD, ALASKA, <br />RECOMMENDING CITY COUNCIL AND KENAI PENINSULA <br />BOROUGH APPROVAL OF A VACATION OF RIGHT-OF-WAY <br />OF THE UNDEVELOPED ALLEY ALONG THE EAST <br />BOUNDARY OF TWO LAKES PARK ABUTTING THE <br />APPLICANT'S PROPERTY (CARLSON/BENCARDINO) AND A <br />PORTION OF THE UNDEVELOPED PORTION OF V AN BUREN <br />STREET ON THE EAST BOUNDARY OF TWO LAKES PARK <br />HAVING A WESTERNMOST BOUNDARY OF THE TOP OF THE <br />RIDGE CREST, IN RETURN FOR WHICH THE CITY WILL <br />RECEIVE PORTIONS OF LOTS 21 AND 22, BLOCK 11 <br />LAUBNER ADDITION TO SEWARD, HAVING AN <br />EASTERNMOST BOUNDARY AT THE TOP OF THE RIDGE <br />CREST, AS SHOWN ON THE PRELIMINARY PLAT AS TRACT <br />A <br /> <br />WHEREAS, the applicants, Louis Bencardino and Dianne Carlson, have <br />requested that the City Council approve a vacation of right of way of the undeveloped <br />alley and Van Buren Street abutting the applicant's property, in return for which the City <br />will receive the West portions of Lots 21 and 22, Block 11, Laubner Addition to Seward <br />as shown on the preliminary plat; and <br /> <br />WHEREAS, this will allow the applicants to build closer to the hillside behind <br />their property and will increase their landholdings, property value and the enjoyment of <br />their property; and <br /> <br />WHEREAS, these portions of the alley adjacent to their property are <br />undeveloped because of steep topography; and <br /> <br />WHEREAS, this will provide more land for Two Lakes Park and allow the City <br />to move closer to replatting all of Two Lakes Park into one parcel as requested by the <br />Commission at the joint work session with Council, May 2002; and <br /> <br />WHEREAS, the applicant shall pay for the surveying, title work and other <br />closing costs as necessary; and <br /> <br />WHEREAS, this action is consistent with the Comprehensive Plan, the Strategic <br />
