<br />Sponsored by: Staff <br /> <br />CITY OF SEWARD, ALASKA <br />PLANNING AND ZONING COMMISSION <br />RESOLUTION NO. 2003-23 <br /> <br />RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS- <br />SION, RECOMMENDING CITY COUNCIL AND THE KENAI PENINSULA <br />BOROUGH APPROVAL OF LOT 3B, BLOCK 1, MARINA SUBDIVISION, <br />MINDENBERGS REPLA T <br /> <br />WHEREAS, Cline & Associates submitted a preliminary plat of Marina Subdivision, <br />Mindenbergs Replat to the City of Seward for review and recommendation to the Seward City <br />Council and the Kenai Peninsula Borough: and <br /> <br />WHEREAS, the property is owned by the City of Seward and leased to Juris Mindenbergs, <br />dba as the Breeze Inn. Mindenbergs is replatting the property in accordance with the terms of the <br />lease agreement which the City Council approved by Resolution 2003-108; and <br /> <br />WHEREAS, the subdivision replat vacates the interior lot line of Lots 7 and 3A, Block 1, <br />Marina Subdivision and creates one 74,180 square foot Lot 3B; and <br /> <br />WHEREAS, the property is in the Harbor Commercial Zoning District; and <br /> <br />WHEREAS, the property is currently serviced by municipal water, sewer and electric; and <br /> <br />WHEREAS, a subdivision installation agreement will not be required for this subdivision <br />because all of the public improvements required by the Seward City Code Title 16 (Subdivision Code) <br />are already provided to the property; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning <br />Commission that: <br /> <br />Section 1. The Commission recommends that the Seward City Council and the Kenai <br />Peninsula Borough approve the Lot 3B, Block 1, Marina Subdivision, Mindenbergs Replat, subject to <br />the following conditions: <br /> <br />1. The final plat must include the following notes: <br />· No permanent structure shall be constructed or placed within an easement which <br />
