CITY OF SEWARD, ALASKA
ORDINANCE 2000-03
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE LAND USE PLAN AND ZONING OF LOT 7,
BLOCK 8, FEDERAL ADDmON FROM OFFICE RESIDENTIAL TO AUTO
COMMERCIAL
WHEREAS, Richard Lewis has requested that the Land Use Plan and Zoning Map
designation of Lot 7, Block 8, Federal Addition be amended from Office Residential to Auto
Commercial; and
WHEREAS, according to Kenai Peninsula Borough tax rolls Mr. Lewis is the owner of Lot
7, Block 8, Federal Addition; and
WHEREAS, Mr. Lewis has applied for the amendment in order to relocate his food service
and equipment to this site; and
WHEREAS, according to the Land Uses Allowed Table (SCC Table 15.10.225) transient
merchants and drive-thru (i.e. fast food) uses are allowed in the Auto Commercial district and
prohibited in the Office Residential district; and
WHEREAS, a restaurant is allowed as an outright use in both the Office Residential and
Auto Commercial districts; and
WHEREAS, Block 8, Federal Addition is designated Office Residential on both the Land Use
Plan and Zoning Maps, and is developed principally with single-family homes; and
WHEREAS, the request meets the technical requirements for amending the land use plan and
zoning designation of Lot 7, Block 8, Federal Addition because it is contiguous with the AC district,
however, the Comprehensive Plan recommends against expanding the boundaries of the AC district;
and
WHEREAS, at its January 5, 2000 meeting, the Planning and Zoning Commission held a
public hearing, and failed to approve a motion recommending Council approval of the proposed
amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. The Land Use Plan and Zoning designation of Lot 7, Block 8, Federal Addition
is hereby amended from Office Residential to Auto Commercial.

Section 2. This ordinance shall take effect ten (10) days following its enactment.
