Project Description:
The proposed project is to access and remove large
rock materials from the Lowell Creek, located on
State owned land. Thc material is planned for use for
embankments for safety of property and roads.
The project subject to this consistency review is to: I)
access and locate large suitable rock material, and 2)
remove the rock material from State owned land for
embankment construction.

Start of ACMP Review
Dear Mr. Dieckgraeff:
The Department of Natural Resources (ADNR), Division of Mining, Land and Water
(DML W), received the Coastal Project Questionnaire and consistency certification,
application, and supporting information you submitted for the proposed project. The
proposed activity is within the coastal zone of Alaska and will be reviewed as required
under the Alaska Coastal Management Program (ACMP) (AS 46.40). This letter initiates
the State of Alaska review of this proposed project under the schedule and process
described in State regulations (11 AAe 110).
The project subject to this consistency review is a material sale. The location IS
Township 1 South, Range 1 West, Seward Meridian, near the City of Seward
No State or federal authorization can be isstled until the final consistency finding is
completed. The ADNR authorization will contain the applicable stipulations that are
required for the project to be consistent with the standards and district policies of the
ACMP as well as applicable ADNR statutes and regulations. Please not that a final
consistency determination does not obligate ADNR to issue an authorization under AS
38.05 or 46.15, nor does it supercede the statutory obligations thereunder. You may not
proceed with any specific land use activity or appropriate water on State lands until
authorized by ADNR.

ADNR, as coordinating agency, has distributed the packet of information you submitted
to the following review participants: Alaska Departments of Environmental Conservation
and Fish and Game, the Office of Project Management and Permitting (OPMP), the
Kenai Peninsula Borough Coastal District, as well as other interested parties (see
enclosed distribution list). A notice posted on July 20th on the ADNR website
(www.dnr.state.ak.us/pic/oubnotfrm) and in sites noted on the public notice posted on
July 20th informed the public of the proposed project.
The project wiII be reviewed under a 50 day review schedule. Deadlines are established
for additional information requests, receipt of comments, and the issuance of proposed
and final determinations, and are listed on the enclosed project information sheet.
Reviewers' comments must be submitted to ADNR on or before 5:00 p.m., on August
2Is1. Comments may include modifications to the project to bring it into compliance with
the ACMP. ADNR wiII review and integrate comments and issue a proposed consistency
determination. The proposed determination wiII notify you of any modifications that will
be required to obtain consistency with the ACMP for the project. Review participants
have five days from receipt of the proposed determination to appeal the decision by
requesting an elevation of the decision.
By a copy of this letter I am informing the State agencies that ADNR has beglID its
consistency review.

Subject to AS 38.05.110 the Southcentral Region, Division of Mining, Land and Water proposes to
open a 10 +/- acre material site for removal of rock within Section 9, Township IS, Range 1 W, of the
Seward Meridian in the Kenai Peninsula Borough. The site is established in Lowell Creek on State-
owned land, for the purchase and removal of rock material by the applicant, Metco, Inc. of Seward
Alaska
The public is invited to comment on the preliminary decision. Copies of the preliminary decision are
available from the Division of Mining, Land & Water, Southcentral Region at the above address.
Written comments, objections, or expressions of interest must be received by the Division of Mining,
Land & Water. Comments can also be Faxed to (907) 269-8913, Attn: Susan G. Bro",ne, or e-mailed
to Susan G Browneraldnr.state.ak.us. All written comments must be received on or before 5:00 P.M.,
August 21 st, 2006. .
If public comments result in significant changes to the preliminary decision, additional public notice
will be given. If there are no significant changes, the final decision will be issued without further
notice. The tinal decision will be available at the above address on or about September 12,2006 and
will be subject to appeal within 30 days under 11 MC 02. To be eligible to appeal under AS
38.05.035(i)-0), a person must submit written comments during this comment period.

We will access the site by using the existing road and the de-watered river bar.
We will be bringing an excavator to the site to pick and load surface rocks onlv.
The rocks ,,,ill be loaded into a side dump and end dumps.
When the mountain ice pack melts, tbe river will refill the area with new rocks

In accordance with Alaska Statute 27.19, reclamation is required of all mining operations, including I
sand and gravel extraction. Completion of this form will meet the law's requirements for a reclamation
plan (see below for filing requirements; due date: at least 45 days before mining is proposed to begin; 1
requires approval by the Division of Mining, Land and Water). Completion of this form will also serve
as a letter of intent for operations exempt from the plan requirement (due date: before mining
begins). No approval is required for a letter of intent. but a miner who files a letter of intent must. before December 31, file an
annual reclamation statement (Section 8 ofthis form).

4. DESCRIPTION OF THE RECLAMATION OPERATION
a. The total acreage that will be reclaimed during the year (or each year, if for a multi-year reclamation plan) is:

c. A time schedule of reclamation measures shall be included as part of the plan.
The following measures must be considered in preparing and implementing the reclamation plan. Please marl< those
measures appropriate to your reclamation activity:
D Topsoil that is not promptly redistributed to an area being reclaimed will be separated and stockpiled for future use.
This material will be protected from erosion and contamination by acidic or toxic materials and preserved in a
condition suitable for later use.
D The area will be backfilled, graded and recontoured using strippings, overburden, and topSOil to a condition that
allows for the reestablishment of renewable resources on the site within a reasonable period of time. It will be
stabilized to a condition that will allow sufficient moisture to be retained for natural revegetation.
D Stockpiled topsoil will be spread over the reclaimed area to promote natural plant growth that can reasonably be
expected to revegetate the area withi n flve years.
o Stream channel diversions will be relocated to a stable location in the flood plain.
D Exploration trenches or pits will be backfilled. Brush piles, vegetation, topsoil, and other organics will be spread on
the backfdled surface to inhibH erosion and promote natural revegetation.
o All buildings and stnuctures constnucted, used, or improved on land owned by the State of Alaska will be removed,
dismantled, or otherwise properly disposed of at the completion of the mining operation.
D Any roads, airstrips or other facilities constructed to provide access to the mining operation shall be reclaimed
(unless otherwise authorized) and included in the reclamation plan.
o Peat and topsoil mine operations shall ensure a minimum of two inches of suitable growing medium is left or
replaced on the site upon completion oflhe reclamation activity.

that nver currents will not be altered and erosion and deposition pattems will not change.

public highway.
o Attach a diagram of the mined area (this term includes the extraction site, stockpile sites, overburden disposal sites,
stream diversions, settling ponds. etc.) and the mining operation as a whole (this term includes the roads you plan to
build, your power lines, support facilities, etc.). Show and state the number of acres to be mined during the year. (If
you checked Box A or B on the first page of this form and your plan covers more than one year, show each year's
work.) Show the location corners or property boundaries of the site in relation to the reclamation work and any other
areas affected by the operation.
o Attach a list of the equipment (type and quantity) to be used during the reclamation activity.
o A lime schedule of events must be attached that includes dates and activities related to this reclamation plan.
o If the site is private land not owned by the miner, attach a signed, notarized statement from the landowner indicating
the landowner's consent to the operation. The landowner may also use the consent statement to notify the
department that the landowner plans a post-mining land use Incompatible with natural revegetation and therefore
believes that reclamation to the standard of AS 27.19.020 is not feasible.
o For those miners that are required to file an annual reclamation statement, attach photographs and/or videotapes
dated and described as to location of the reclamation activity that was completed.
o If you propose to use reclamation measures other than those listed on this form, or if the private landowner or public
land manager of the site requires you to use stricter reclamation measures, attach a list of those measures.
